The Competition Authority again fines the company that manages parking at Tirana Airport

The Competition Authority has again fined the company Star Parking Albania, for non-compliance with the obligations imposed on it, after the closure of the in-depth investigation in the market of the parking facilities management of the "Mother Teresa" airport.
In support of the monitoring report, the Competition Commission decided to fine Star Parking Albania in the amount of ALL 756,581 for non-implementation of the obligations sanctioned in the decision of the Competition Commission of 2022.
In November 2022, the Competition Authority closed the in-depth investigation procedure in the "Mother Teresa" airport parking facility management market and fined the company Star Parking Albania in the amount of 1% of the annual turnover or about 1.6 million ALL.
The Competition Authority in that case assessed that the commitments filed by Star Parking Albania LLC were sufficient to address competition concerns in the market for the management of parking facilities at the "Mother Teresa" Airport (Tirana International Airport), defining these commitments as mandatory, in the form of conditions and obligations.
The enterprise Star Parking Albania was left as an obligation to design a methodology for calculating costs for the formation of the price of the telepass and to apply cost-oriented tariffs, for enterprises that are equipped with telepass as well as for any other service.
In addition, the Star Parking Albania company was imposed the obligation provided for in the law "On the protection of competition not to abuse the dominant position, especially by setting, directly or indirectly, unfair purchase or sale prices or conditions of other unfair trade practices; limiting production, markets or technical development; the implementation of unequal conditions for the same commercial actions with the parties, placing them in a competitive disadvantage; establishing the conditions for the conclusion of contracts with other parties, so that the latter accept additional obligations, which, by their very nature or according to commercial practices, are not related to the object of the contracts in question.
In order to fulfill the conditions and obligations defined in the decision, Star Parking Albania will be monitored for a period of 1 year.
But, after one year of monitoring, the Competition Authority has concluded that the company has not implemented these obligations.
From the contracts related to the enterprises that require the telepass service, it has been observed that the condition that "Star Parking charges a payment of 6000 lek in case of loss or damage of the telepass as compensation", is not defined for all enterprises that have a telepas contract with Star Parking, but only for the companies Global Fast Food Albania SHPK, A&A Aeroport SHPK and Air Albania SHPK.
In the contracts of 2023, Star Parking for the company Global Fast Food Albania LLC has determined "the obligation for a telepass in the value of 6000 ALL" and for the enterprise Air Albania LLC has defined "the obligation for a telepass in the value of 180 thousand ALL", while for the company The Old Mill LLC has determined "the obligation of 180 thousand ALL for a telepass for one license plate" and for the company Sombrero LLC "the obligation of 180 thousand ALL for one telepass for one license plate".
It is noted that for other companies, the contract only stipulates the obligation for the number of telepas required, without specifying the license plate condition.
The company Alba Wings in 2022, for a duration of one year, paid 72 thousand ALL for one telepass, while the company Air Albania in 2023 for two telepasses with a duration of one year paid a total of 360 thousand ALL.
Based on the above examples, for the Competition Commission it appears that the company Star Parking Albania has implemented unequal conditions with the companies that enter into a contract to be equipped with telepas and has not presented a reason for this different treatment.
For this reason, the Commission has imposed a fine on Star Parking in the amount of 756,581 ALL, as well as the continuation of the monitoring of the implementation of the conditions and obligations defined in point III of the decision of the Competition Commission no. 921, dated 09.11.2022 "For the closure of the in-depth investigation procedure in the market of the management of the parking facilities of the "Mother Teresa" Airport and the approval of the commitments as mandatory in the form of conditions and obligations for the company "Star Parking Albania ShPC" , even for a period of 1 year.
