The fate of democracy in the hands of the superior courts of Albania!

The Constitutional Court, through the Judicial and Legislation Directorate, announced that on November 26, it decided to finally review in a public plenary session the request of many political subjects for the repeal of the law on the electoral code of 2008, as well as that of of 2024 as incompatible with the country's constitution

To simplify the constitutional notions for the reader, it is about two open parliamentary agreements Berisha-Rama that prevent equality of votes and the creation of pre-election political coalitions.

Also, the "Achilles' heel" of this deal is the closed party lists, which atrophies competition, meritocracy, invalidates and alienates the vote of citizens and seals the autocracy of the mayors.

The Euro-Atlantic Democrats have continuously insisted that this law be changed and that the lists be

open, so that Albania is not divided into political plots related to Berisha-Rama occult interests, but is an electoral area where the citizens' vote is translated into political trust precisely for the candidate who wins the race, that is why some Euro-Atlantic MPs supported by some parties politicians of the Euro-Atlantic Opposition Arch have appealed to the Constitutional Court.

In fact, there is no place for legal interpretation here, as the logical one prevails, but the duo that has taken democracy hostage has invented this legal amalgam just to extend their political reign and the survival of bipolarism in Albanian political life.

It was for this reason that arbitrarily a trio of judges of the Court of Appeal, contrary to the decision given by the Supreme Court, stole the name, initials and seal of the PD, passing it to the pulpit of Sali Berisha, an unlicensed organization, in complete illegality. legally, that he had created his own organizations in football stadiums in violation of the statute and sanctioned internal norms of the DP, with falsification of forms and seals.

The decision of the judges of the Court of Appeal, I emphasize in opposition to the decision of the Supreme Court, destroyed the electoral judicial hierarchy of the elections of May 14, 2023 and delegitimized the entire process.

The Euro-Atlantic Democrats, although

Injured people did not use the squares and road axes, nor did they receive the molotov and tritol, but in respect of the principles that dominate them, they directed you to the Supreme Court with legal recourse and the Constitutional Court with an appeal.

This is the basic principle of the Euro-Atlantic democrats, the implementation of the law and the decision of the country's courts, as well as listening wisely to the suggestions of the allies, and not the charlatan path of uprisings and "Xhafa" type commissions, as the non grata of Ndoc Rrokët e gang act. old political.

In these conditions, the Supreme Court and the Constitutional Court have the moment of their life and existence as unequivocal guardians of the law and the constitution to show not only responsibility and legal competence, but to finally open the way for pluralism and democracy wounded in the last dramatic agony to breathe .

If we personally have been unconditional supporters of the new justice, this does not presuppose that we enjoy this only from the laudable fruits of SPAK and GJKKO, but in the entirety of the judiciary in the country.

The reform in justice must work in a fair and capillary way, otherwise the Prosecutor's Office and the Special Court are

destined not only to impress and intimidate but also to remain alone in front of the malignant caste of the old politics.

I understand that from the very composition of political and institutional interests in the superior courts there are also people who try to protect their "benefactors", but I assure you that it is the last case that the majority must rise above petty interests and prove at least a professional level legal.

This would not only raise their level of national and Euro-Atlantic credibility to the level of SPAK, but they would do a valuable service to democracy, the rule of law, stability and integration of the country.

Otherwise, they will receive the pejorative designation that the courts of the dictatorship had, or the poplar courts that are not based on the law but on the occult political interests of the bosses.

With faith in a fair judgment, not only legal but also humane, in the service of

a democracy choked by political and economic corruption, aided by dangerous segments of organized crime, by dark Slavic Russian interventions and sponsorships to destabilize us, I conclude my reflective appeal.
