"Battle" for freedom/ After Berisha, the Constitution sets the hearing for Malltez
The Constitutional Court has set December 5, at 10:00 a.m., for the review of the appeal made by the son-in-law of former Prime Minister Sali Berisha, Jamarbër Malltezi, against the security measures imposed on him on account of the "Partizani" file.
In this court, Malltezi seeks to annul the measure of "prison arrest" assigned to him in October 2023, that of "house arrest", assigned to him a month later, as well as its confirmation in the Supreme Court. The Constitutional Court's review of the appeal made by Malltezi, who continues to remain under "house arrest", will be conducted on the basis of documents, without the presence of the parties.
Since September 11, the son-in-law of the former prime minister has been charged by SPAK on the charge of "passive corruption of high state officials or local elected officials", in collaboration and "money laundering".
Earlier, the Constitutional Court set the date of November 19 for the review of the appeal made by former Prime Minister Berisha against the first measure "obligation to appear" and "ban on leaving the country". The former prime minister claims a violation of the Constitution by the courts, which approved the request for the appointment of a security measure against him without first obtaining authorization from the Assembly of the Republic, due to his special qualities as a deputy.
Two weeks ago, SPAK communicated the completion of the investigation to the 5 defendants of the "Partizani" file, while it took another month to familiarize itself with the objections presented by the defendants and file the file in court for preliminary review.
