The more she digs, the longer the list of violations in the Llogora tunnel scandal becomes. The Minister of Infrastructure, Belinda Balluku, is not only accused of canceling on her own order (because she didn't feel well) a tender won for 140 million euros, only to announce a new one a few months later for 190 million euros. She is not only not held responsible for predetermining a merger of Turkish companies with which she contacted before the tender in Ankara.

But, from a detailed reading that Lapsi.al has made of the accusations against her found in the SPAK file, she also bears responsibility for the fact that the Turks, Interkar-ASL, did not even prepare the papers to formally meet the criteria of the tender that was tailor-made for them.

As for the other participating companies that were burned because they were asked to find a needle in a haystack, SPAK claims that the predetermined winners were turned a blind eye in at least six cases.

According to what is noted in the file against Balluku that Lapsi.al has managed to read, the company "... INTERKAR-ASL... was declared the winner in violation of the criteria set out in the Standard Tender Documents and this happened thanks to the illegal actions of Minister Belinda Balluku...." in collaboration with members of the bid evaluation committee.

What exactly are these violations that the commission committed under the orders of the boss who had predetermined the winner? First, the Turks of INTERKAR-ASL did not present the complete documentation of the special machinery required for the construction of the Llogara tunnel.

.Secondly, they have not submitted individual employment contracts for 250 employees, including specialized professionals. Thirdly, they lack complete documents according to the criteria required by the tender for quality management system and environmental certificates. Fourthly, they have not submitted convincing documentation for experience in building a bridge at least 12m long. Finally, they have not been able to prove whether their capital and assets were not blocked by any enforcement order. And sixthly, they have had shortcomings in the translations of documents and their presentation in English.

Precisely for these reasons, SPAK concluded that the failure to meet the tender criteria by the winners was one of the aggravating factors in the indictment of Belinda Balluku.

Of course, if these violations are also seen against the background of the communications captured between the minister and her subordinate, the director of roads Evis Berberi, where Balluku directs every step of the tender manipulation, the picture becomes more complete. It is not for nothing that Prosecutor Dritan Prençi has reached the conclusion that “Belinda Balluku, in her capacity as Minister of Infrastructure and Energy, has continuously followed and guided the procedure of this public procurement, in the preparatory phase, during the development of the procedure and until the moment of announcing the winner, creating unfair advantages and privileges for the union of economic operators INTERKAR-ASL”.

But the six points of violations above are proof that the Turks felt so sure of themselves as winners determined from above that they did not even bother to sew the papers, although they left this story with nearly 30 million euros in profit divided in the form of dividends./Lapsi.al
