The elections in Tirana may take place after the Constitutional Court's decision on October 31 on Erion Veliaj's appeal regarding his dismissal from the Municipal Council and the Council of Ministers, or they will be postponed until the next ones in 2027, according to the mandate.

This was stated today by the former head of the Central Election Commission, Kristaq Kume, who also indicated the legal and electoral path that the process for the capital will follow after the revocation of President Bajram Begaj's decree for the November 9 by-elections.

"On October 31, the judicial review of Veliaj's lawsuit regarding his dismissal will begin, and depending on the decision the court will make, two scenarios are possible: holding new elections after the Constitutional Court's decision or not holding elections, leaving the current situation unresolved until the next elections in 2027," said Kume, among other things, in the "News24" studio.

But why did the Constitutional Court dismiss the head of state? According to Kume, the President should have also evaluated Article 115 of the Constitution, but he overlooked it, evaluating only the legal issue and the initiative of the Council of Ministers with the announced vacancy.

"The Constitutional Court's decision was made to suspend the presidential decree and is a preventive action, aimed at avoiding irreparable consequences, as long as the lawsuit filed by former mayor Erion Veliaj against the decision to dismiss him has not yet been judged. Anyone who files a lawsuit accompanies it with a request not to act until a judicial decision is made. In this case, the Constitutional Court decided to suspend the President's decree on the elections in Tirana to protect against possible irreparable consequences, given that Veliaj's appeal has not yet been reviewed," Kume told News24.
