"Concrete is being poured without steel"/ Investigations raise

After a site inspection in July 2022, the Greek representative of the company supervising the works on the Llogara tunnel was left shocked. He wrote in alarm to the head of the Albanian Road Authority, Evis Berberi, that things were getting worse and worse with the project.

"Evis...the contractor must understand that the project is not just a "hole", but is a tunnel which must be built according to international specifications and practices in ABSOLUTE respect for SAFETY issues..." Ioannis Kirkinezis, representative of the company "Hill International NV", wrote to Berber.

The Special Prosecutor's Office's investigation into the former head of the Albanian National Construction Agency, Evis Berberi, shows that tensions increased in the months that followed. In many episodes described in the file, Kirkinezis complains about the quality of the works, the lack of projects or "total negligence and insult" on the part of the subcontractor.

The messages exchanged between Kirkinezis and Berber reveal a complicated relationship. They date back to August 2021, after the Ministry of Infrastructure opened the tender for the supervision of works on the Llogara tunnel, with a limit fund of 196.2 million lek.

The winners of the tender were announced as the company "Hill International" represented by Kirkinezis and "Net Group" sh.pk, but the Special Prosecution claims that this is another manipulated tender after the one for the construction of the Llogara tunnel and accuses Berber of predetermining the winner.

According to SPAK, Kirkinezis himself drafted the criteria set out in the standard tender documents and in return took as a partner the company "Net Group" sh.pk, which according to the investigation was linked to Berberi.

The former head of the Albanian Anti-Corruption Agency (ARA) was sent to trial in June this year along with 18 others on charges of corruption, abuse of office and money laundering. In a larger scheme, also revealed by messages on Berber's phone, the latter and Deputy Prime Minister Belinda Balluku are accused of being involved in fixing the winner of the 18.9 billion lek tender for the construction of the controversial Llogara tunnel.

Seen together, the two files show traces of a systemic problem in the infrastructure sector with the fictitious announcement of public tenders, while the “bargaining” for the criteria and winners had been completed. The former head of the ARRSH, Evis Berberi, has denied the Special Prosecution’s allegations, while Minister Belinda Balluku has avoided comment, stating that she “has faith in justice.” Kirkinezis was unavailable for comment.

Tuneli i Llogarasë, që lidh Vlorën me fshatrat turistikë të Jugut, është një prej projekteve më të mëdha dhe të kushtueshme të infrastrukturës në pesë vitet e fundit. Ai është po ashtu një prej projekteve më kontroverse për shkak të funksionit të kufizuar.

Hetimet e Prokurorisë së Posaçme sugjerojnë se qoftë tenderi për ndërtimin e tunelit, qoftë ai për mbikëqyrjen e punimeve u paracaktuan.

Mesazhet e kapura në telefonat e Berberit tregojnë sipas SPAK se ky i fundit është karakteri kyç dhe një prej përfituesve të aferave. Procedurat e tenderimit të mbikëqyrjes filluan thuajse në të njëjtën kohë me tenderin për punimet. Ato përfunduan në dhjetor 2021, por fituesi ishte i qartë që prej kontakteve të para mes Kirkinezis dhe Berberit në gusht 2021.

Prokuroria thotë se ka dokumentuar që Berberi ka orkestruar një skemë të mirëfilltë, duke nisur nga “qepja” e kritereve të tenderit për kompaninë Hill International, vendosjen e saj në lidhje me kompaninë Net Group, e deri te kualifikimi i këtij bashkimi operatorësh me dokumente të falsifikuara, për të përfunduar në përfitimin e miliona lekëve përmes një skeme faturash fiktive mes Net Group të Valter Begajt dhe DAAM, që SPAK thotë se kontrollohej nga vetë Berberi.

Para se procedura të shpallej zyrtarisht, hetuesit kanë zbuluar komunikime intensive mes Evis Berberit dhe Ioannis Kirkinezis. Në një komunikim SMS të datës 27 gusht 2021, Kirkinezis i shkruan Berberit: “Përshëndetje! A ke ndonjë lajm për ofertuesin për mbikëqyrjen/supervizimin e Llogarasë? E pashë që kriteret janë shumë të forta. A mund të diskutojmë?”.

Pas këtij mesazhi, të dy organizojnë një takim dhe në tetor 2021 kur ARRSH po bënte gati kriteret për tenderin, Kirkinezis i dërgon Evis Berberit në email-in e tij zyrtar një dokument me detaje teknike të grupit që duhej të kryente mbikëqyrjen e projektit.

Prokuroria gjeti se njësia e prokurimit që ndiqte rastin i përshtati kriteret e ekspertëve pikërisht sipas këtij dokumenti, duke zvogëluar numrin e inxhinierëve dhe specialistëve pjesëmarrës sipas kërkesës së Kirkinezis.

Në mënyrë të dyshimtë, kur dokumentet përfundimtare të tenderit u miratuan më 22 nëntor 2021, lista e stafit të kërkuar ishte identike me atë që përfaqësuesi i kompanisë “Hill International”, Ioannis Kirkinezis, i kishte dërguar me email Evis Berberit një muaj më parë. Kriteret ishin ndryshuar për t’iu përshtatur kompanisë specifike.

“Në rrethanat e mësipërme rezulton se kriteret e vendosura tek dokumentet standarde të tenderit janë përgatitur nga përfaqësuesi i shoqërisë holandeze “Hill International N.V”, shtetasi grek, Ioannis Kirkinezis, shoqëri që ka marrë pjesë në këtë procedurë prokurimi, si bashkim i operatorëve BOE “Hill International N.V” & “Net Group” sh.p.k”, thuhet në dosjen hetimore.

Pasi kriteret ishin përshtatur, Berberi i ka sugjeruar, sipas hetimeve të SPAK,  kompaninë Net Group të Valter Begajt.

Të dyja kompanitë, “Hill International NV” dhe “Net Group”, krijojnë një bashkim operatorësh dhe marrin pjesë në tender. Por, sipas dosjes hetimore, ky bashkim operatorësh nuk i plotësonte as kriteret e “qepura” për ta, pasi kishte mungesë të përvojës dhe stafit të kualifikuar. Megjithatë ata e fituan tenderin.

Ajo që nuk del në mesazhe, por që është gjetur nga hetimi tregon se ky orientim nga Berberi nuk ishte i paqëllimtë. SPAK ka gjetur se përmes Net Group dhe kompanisë DAAM, Berberi përfitoi dhjetëra milionë lekë në këtë rast dhe 7 procedura të tjera prokurimi. Paratë thotë prokuroria u transferuan me fatura fiktive.

Sipas hetimit, pasi Ministria e Infrastrukturës dhe Energjisë paguante kompaninë “Hill International NV” (dega në Shqipëri) për shërbimet e mbikëqyrjes, kjo e fundit i transferonte “Net Group” sh.p.k një pjesë të pagesave. Deri në nëntor 2024, “Net Group” ka përfituar rreth 74.3 milionë lekë nga “Hill International”, por nga këto para, 19.2 milionë i kaluan kompanisë DAAM , që prokuroria thotë se zotërohej de facto nga Evis Berberi. Transfertat justifikoheshin me fatura fiktive për “specialist për tunelin Llogara”.

Sipas Prokurorisë së Posaçme, një listë e gjatë ekspertësh nga Greqia që ishin deklaruar se do të bënin mbikëqyrjen e punimeve të tunelit nuk e kaluan kurrë kufirin. Ngjashëm një numër ekspertësh shqiptarë që supozohej se punonin për kompaninë Net Group nuk qenë kurrë në Llogara. Në dëshmitë e marra nga prokuroria mësohet se këta ekspertë kishin huazuar licencat për pagesa minimale mujore, por kurrë nuk u thirrën të punonin.

Prokuroria thotë se ata që bënë mbikëqyrjen ishin të ndryshëm nga lista me të cilën kompanitë fituan tenderin. Sipas prokurorisë ky zëvendësim masiv i stafit kryesor, sipas dosjes, u bë pa miratimin me shkrim të Autoritetit Kontraktor, në shkelje të kontratës.

Telashet e mëdha duket se filluan kur kompania “Hill International” tentoi të kryente mbikëqyrjen. Gjatë zbatimit të projektit, komunikimet në “Signal” mes Kirkinezis dhe Berberit tregojnë se përfaqësuesi i “Hill” filloi të ankohej për problemet me ndërtuesin që neglizhoi projektin, cilësinë e materialeve dhe një sërë hallesh të tjera, që sipas tyre vinin në rrezik tunelin.

Mbikëqyrësit e Hill që vërtet erdhën në Shqipëri, ngritën alarmin për cilësinë e punimeve në tunel. Ata ankohen se kompania ndërtuese po punonte pa plan apo me plane të ndryshuara. Ata gjetën se nuk po përdorej çelik në betonin që hidhej në tunel dhe se kompania që po kryente punimet, hoqi elemente sigurie nga tuneli.

Procesverbalet e këqyrjes së telefonit “Iphone 13 Pro Max” të Evis Berberit, të sekuestruar gjatë kontrollit të banesës së tij, zbulojnë në detaje përmbajtjen e këtyre ankesave.

Communications on the Signal app show that Ioannis Kirkinezis regularly informed Berberi of serious violations by the builder and the disregard he was showing for his role as a supervisor, as he wrote, "the builder does not respect the supervisor's requests and instructions."

The complaints culminate in November 2022, when he reports alarming safety violations, such as the fact that the contractor was pouring “concrete without steel. Not reinforced.” He also warns Berber that the new ventilation design had “no provisions for fire,” adding that this would endanger the lives of passengers.

"The Contractor's new proposal deals only with normal operating conditions, without any provisions for fire cases. If such an incident occurs, there will certainly be casualties," Kirkinezis writes to Berber.

Unlike what is presented in the first part of the scheme, where Berber is invested in communications with Kirkinezis, in this part of the communications where the quality of the tunnel is discussed, he appears indifferent.

This indifference frustrates his partner from Greece. “Do you think we have any added value to the project or any function?” he writes, pleading for a meeting with the Barber.

In another message quoted in the file, Kirkinezis told Berber: "We are in this project because of you AND FOR YOU. Just tell me what to do and I will follow your advice completely."

The fate of the quality of the works is unclear in the file. In his testimony to the Prosecution, Kirkinezis stated that after frequent communications with Berberi about the quality of the works, he had warned him that he could withdraw from supervision if “we were useless.”

"After this message, a meeting was held and the situation improved. The builder was working with quality and safety and the project was completed on time," Kirkinezis said in testimony./ reporter.al
