Officially charged with two criminal offences/ Berisha's son-in-law Jamarbër Malltezi risks jail for many years
The former prime minister and his son-in-law Jamarbër Malltezi climbed the steps of the prosecution body SPAK today, where both defendants were officially arrested.
Sali Berisha is accused by SPAK of the criminal offense of " Passive corruption of high state officials or local elected officials", committed in cooperation with the citizen Jamarbër Malltezi, provided for by article 260 and 25 of the Criminal Code.
Meanwhile, his son-in-law Jamarbër Malltezi is accused of " Passive corruption of high state officials or local elected officials" and "Cleaning of the proceeds of a criminal offense or criminal activity", provided by article 287, second paragraph of the Criminal Code.
The Criminal Code provides that these offenses have the highest penalties in the field of corruption.
The offense of passive corruption is punishable by imprisonment from four to twelve years. Money laundering with five to fifteen years.
So if the charges are confirmed and in the end Berisha is found guilty, then he risks a maximum of 12 years in prison. While Malltezi risks a maximum of 27 years in prison.
Article 260- Passive corruption of high state officials or local elected officials
Seeking or receiving, directly or indirectly, any improper benefit or promise of any kind, for oneself or other persons, or accepting an offer or promise of improper benefit, from a senior government official or the local elected official, for performing or not performing an action related to his duty or function, is punished with imprisonment from four to twelve years.
Article 287- Purification of the proceeds of the criminal offense
1. Cleaning of the proceeds of the criminal offense carried out through:
a) exchange or transfer of property, which is known to be the product of a criminal offense, to conceal or disappear the illegal origin of the property or to provide assistance to avoid the legal consequences related to the commission of the criminal offense;
b) hiding or covering up the nature, source, location, placement, transfer of ownership or other rights, related to the property that is the product of the criminal offense;
c) performing financial actions and fragmented transactions to avoid reporting,
according to the money laundering law;
ç) earning, possessing or using property, when it is known that it is the product of a criminal offense; d) advising, inciting or publicly calling for the commission of each of the offenses defined above, shall be punished with imprisonment from three to ten years and a fine from ALL 500 thousand to ALL 5 million.
2. When this offense is committed during the exercise of a professional activity, in collaboration or more than once, it is punished with imprisonment from five to fifteen years and a fine from ALL 800 thousand to ALL 8 million, while when it has brought consequences of serious, shall be punished with imprisonment of not less than fifteen years and a fine of 3 million to 10 million ALL.
