Kastrati and Dulaku sued SPAK&GJKKO, the Constitutional Court leaves "Marina Bay Saranda" in sequestration

The Constitutional Court rejects the request of the "Marina Bay Saranda" company, on the lifting of the sequestration for the naval base in the coastal city. After losing the process in all three levels, the society in question turned to the Constitutional Court, which decided to overturn this request. With this decision, the Saranda naval base will continue to remain under seizure until SPAK completes its investigations.
The naval base of Limion was seized by decision of GJKKO in February 2023, after the request of SPAK on the grounds that its privatization had affected the operationality of the naval forces.
The concession company initially appealed the decision to the Special Court of Appeal, but the black squads upheld the decision of the first instance. On May 16, the company appealed the decision again, this time to the Supreme Court. But this court has also decided to leave the naval base in sequestration. Meanwhile, the highest court in the country, the Constitutional Court, rejected the request for lifting the sequestration of the company 'Marina Bay Saranda'.
How did the clash between the Government and the Special Prosecutor's Office arise?
It is about the contract that through the Ministry of Defense headed by Mrs. Olta Xhaka at the time, the two businessmen Artan Dulaku and Shefqet Kastrati received the military port in Saranda with PPP.
SPAK has imposed a seizure measure against this contractor and the physical object on the ground, while unofficially it is known that beyond the measure, there the works have continued even though there is a court decision in force.
The sequestration measure was appealed at the three levels of the judiciary, but it was left in force by approving the decision of SPAK, by GJKKO, GJKKO Appeal and the Supreme Court. This investigation is followed by the Monjola Kajana prosecutor's office, which during the investigation also requested the imposition of a seizure measure.
In the framework of this criminal proceeding in SPAK, the former Minister of Defense, Ms. Xhaçka, also testified earlier. The Albanian Government is an interested party in this process and is represented through the State Attorney's Office.
