The two architects arrested
The Prosecutor's Office of Tirana has charged 10 people in connection with 7 villas in the preferred area of Petrela, very close to the shopping center "TEG", which in November of last year, it was discovered that false documents had been used to provided with a construction permit, within the Reconstruction process.
The two arrested architects, Armand Prelezi and Klevis Bregu, are charged with the criminal offense of "Forgery of documents". Also, the citizens: Manush Teqja, Florian Zela, Abaz Teqja, Mehmet Durishti, Tefta Visha, Dorina Dushku, Arblin Harizi and Gani Moka have been charged.
"In the area of Mullet, in the forest economy 1/a and 2/a, 7 objects (villas) were built, formally equipped with a reconstruction permit, but it turned out that the legal technical documentation used reflected false data, as well as violating the forest fund, under the jurisdiction of the Municipality of Tirana." - it is stated in the notification of the Prosecutor's Office.
Also, at the request of the Prosecutor's Office of Tirana, a preventive seizure was also imposed on 7 illegal villas.
From the simple verification of the coordinates through the 'Google Maps' application, it appears that the data reflected in the relations by the architects Armando Prelezi and Klevis Bregu, show different locations compared to the real location of the objects ascertained from the self-declarations made to the State Cadastre Agency . According to the prosecutor's office, the facilities were built in the plots of forest economies 1/a and 2/a, in the jurisdiction of the Municipality of Tirana.
On the other hand, one of the persons under investigation, Gani Moka, administrator and partner of the company Certi VV South Balkans, signed a lease contract on April 14, 2021 with the Parks and Recreation Agency for the area of 2000 m2, which is part of the forest fund , plot 1/a, where in fact the constructions were erected with the false data.
During the compilation of the relevant acts, it was found that some of the structures with iron and concrete as well as the surrounding wall are positioned on an area of the forest fund which has been put to use. This scheme of action, according to the prosecution, occurred as a result of the use of false data by architects Armando Prelezi and Klevis Bregu through the E-permit system.
As a result of the investigation, the prosecution has seized three areas of 370 square meters each, in the name of Manush Teqe, Florian Zela, Abaz Teqe and Arblin Hariz, and a 360 square meter area of Dorina Dushku. One of the persons under investigation, Gani Moka, owner of the company Certi VV South Balkans on May 21, 2021 was raped by citizens Seit Manahasa and Kreshnik Manahasa who asked him to pay them 20 thousand euros.
The perpetrators held Moka and one of his employees hostage after stripping them and filming them, threatening to make the footage public if they did not pay 20,000 euros. Moka and his employee were released only after the perpetrators received 12 thousand new lek and promised not to report the incident to the police. A day after the event, RENEA arrested 38-year-old Seit Manahasa and announced his 37-year-old cousin, Kreshnik Manahasa, wanted.
The scheme used by the two architects is interesting. They have designed villas for their clients, similar in volume and shape to the villas of a residential complex, called "Secret Residence". The buildings designed by the two arrested architects are located exactly next to the surrounding wall of the complex and look like their continuation.
Perhaps it was intended as a form of hiding illegal cottages. But who were they hiding from?
"Boldnews.al" has secured part of the investigation file of the Prosecutor's Office of Tirana, in which it is easy to see that the structures of the Municipality led by Erion Veliaj had an overlap of powers, or at least that is the official justification, and for this reason it is not verified the situation on the ground of these 8 new villas.
No one from the state authorities has seen those villas being built or checked them for legality.
Only at the beginning of January 2023, when the new buildings had taken their almost final shape, at the address of Commissariat No. 1, which covers the area, a series of denunciations and information about unauthorized constructions adjacent to "Secret Residence" arrived.
Police officers informed the Tirana Local Construction Inspectorate, which until that time did not have any information. On January 12, 2023, the construction inspectors identified the villas without permission, suspended the works, fined their "owners", and also referred the materials to the Prosecutor's Office for "illegal construction".
Falsification of earthquake expert reports
On June 17, 2022, the Mayor of Tirana, Erion Veliaj, approved the construction permit with the object "Reconstruction of the damaged building, as a result of natural disasters, without addition or change of volume", in favor of citizen Manush Teqia.
The application for this permit on behalf of Teqia was made by the architect Armand Prelezi. The application file uploaded to the relevant electronic system contains, among other things, the act of in-depth expertise carried out by the Construction Institute, drawn up in December 2019, which constitutes a decisive document for the Reconstruction.
Based on this act, Manush Teqia's building in Petrelë is damaged at DS5 level and must be rebuilt.
The Prosecutor's Office of Tirana, as part of its investigation, received a letter from the Construction Institute in June 2023, in which it is stated that no inspection was carried out on the properties or on behalf of Manush Teqia.
This detail created the suspicion of the prosecutors that the document of the Institute of Construction is forged.
In the same way, the Construction Institute informed the Prosecutor's Office of Tirana that it did not carry out any kind of expertise on behalf of Arblin Harizi, Abaz Tegja and Florian Zela, who also turned out to have applied for and been granted a building permit within the framework of the Reconstruction in the same area.
Change of coordinates
In the framework of the same investigation, the Prosecutor's Office of Tirana created doubts that the applications made by Armand Prelezi and Klevis Bregu for the reconstruction of the buildings of the above citizens, as well as those of Dorina Dushku, Gani Moka, Tefta Vishi and Mehmet Durishti, were made by abusing with the coordinates of the construction site and the volume of the villas on floors and surface.
From the verifications carried out by the Prosecutor's Office of the coordinates through the "Google Maps" application, it turns out that the data reflected in the relations by the architect Armand Prelezi or Klevis Bregu, show different locations, compared to the real location of the objects ascertained by the self-declarations near the State Cadastre Agency (ASHK), or even without a location, not advertising the coordinates.
The municipality "has no eyes"
The Prosecutor's Office of Tirana has asked some local construction inspectors, to better understand how it happened that no one has seen the construction of seven villas without permission in one of the areas most beaten by the "bosses" of the capital, but also of Albania.
The inspectors asked mainly referred to an internal organization of the Municipality of Tirana, which at best turns out to be defective. They have stated that no checks were carried out in these objects before January 2023, since the control of Reconstruction permits was not the competence of the Land Directorate.
According to them, the Reconstruction Permits have a legal obligation that the buildings must be built on the footprint of the old building and must notify the Territory Protection Inspectorate, Tirana Municipality, for the start of the works, since the building must be built with the same dimensions and in the place of the same.
"Until January 2023, the Reconstruction Permits were controlled by the Directorate of Permits Control and it was not the competence of the Land Directorate", inspectors E. Belalla, R. Myrta and L. Alushi declared in the same way before the prosecutors.
So, it seems that because of this organization, the structures of the Municipality of Tirana, which are very vigilant about the unauthorized construction of courtyard walls or opening windows, have not seen the illegal construction of seven villas in a luxury area.
Announcement of the Prosecutor's Office of Tirana:
The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, has registered Criminal Procedure no. 1285, of the year 2023 (United), for the criminal offense of "Illegal Construction" provided by Article 199/ai of the Criminal Code.
In the function of the preliminary investigations as far as it has been reported, intensive investigations were carried out by the prosecutor's office, such as questioning of persons, inspections and seizures at institutions as well as carrying out technical expertise, and in the end the conclusion was reached that word for consumption of the elements of criminal offenses provided by articles 199/a/3, 186/2, 186/3 in cooperation and 300 of the Criminal Code, as in the area of Mullet, in the forest economy 1/a and 2/a, 7 buildings (villas) have been built, formally equipped with a reconstruction permit, but it has turned out that the legal technical documentation used reflected false data, as well as violating the forest fund, under the jurisdiction of the Municipality of Tirana.
Under these conditions, the prosecutor's office has estimated that there is evidence and reasonable suspicion to proceed with taking the citizens as defendants for the criminal offenses as follows:
Armand Prelezi, architect, accused of the criminal offense "Forgery of documents" provided by article 186/3 and 25 of the Penal Code;
Klevis Bregu, architect, accused of the criminal offense "Forgery of documents" provided for by article 186/3 and 25 of the Penal Code;
Manush Teqja, accused of the criminal offense "Illegal construction" provided by article 199/a/3 and "Forgery of documents" provided by article 186/2 of the Penal Code;
Florian Zela, accused of the criminal offense "Illegal construction" provided by article 199/a/3 and "Forgery of documents" provided by article 186/2 of the Penal Code;
Abaz Teqja, accused of the criminal offense "Illegal construction" provided by article 199/a/3 and "Forgery of documents" provided by article 186/2 of the Penal Code;
Mehmet Durishti, accused of the criminal offense "Illegal construction" provided by article 199/a/3 and "Forgery of documents" provided by article 186/2 of the Penal Code;
Tefta Visha, accused of the criminal offense "Illegal construction" provided by article 199/a/3 and "Forgery of documents" provided by article 186/2 of the Penal Code;
Dorina Dushku, accused of the criminal offense "Illegal construction" provided by article 199/a/3 of the Penal Code;
Arblin Harizi, accused of the criminal offense "Illegal construction" provided by article 199/a/3 and "Forgery of documents" provided by article 186/2 of the Penal Code; AND
Gani Moka, accused of the criminal offense of "Illegal construction" provided by article 199/a/3 and "Discrediting the crime" provided by article 300 of the Penal Code.
At the same time, referring to the provisions of Article 274 of the Code of Criminal Procedure, by the Prosecution at the Court of First Instance of the General Jurisdiction of Tirana, the seizure of illegal objects was requested and with decision no. 3625 dated 20.11.2023 the Court of First Instance of The General Jurisdiction of Tirana has disposed of the preventive sequestration on the built objects.
Investigations continue in the direction of the actions and omissions of public entities as well as possible collaborators for the criminal offenses of "Forgery of documents" and "Abuse of duty" provided by article 186/3 and 248 of the Criminal Code.
