The Constitutional Court has dismissed the lawsuit of former Health Minister Ilir Beqaj, who requested the abolition of the 'prison arrest' measure, while he has been isolated in Durrës detention center for more than a year.

The former minister was arrested by order of SPAK on July 4, 2024 for the SASPAC funds scandal file, where he is accused of abusing foreign donations, while he is also being tried under ordinary procedure for the "Sterilization" file.

Ilir Beqaj is accused of committing theft by abusing the public office of the head of the ministry.

He has requested freedom several times at various levels of the judiciary, but has been overthrown by the black platoons. The former minister, who has denied the SPAK accusations, even offered a financial guarantee of 50 thousand euros two days after being placed in handcuffs, but his proposal was not accepted.

SPAK accuses Ilir Beqaj of abuse of office in connection with the surgical equipment sterilization concession, a 10-year concession contract worth nearly $100 million, which was signed in December 2015 and is still ongoing.

The former Minister of Health will be investigated for "abuse of office committed in collaboration" in concession procedures under the security measure "compulsion to appear" and "ban on traveling abroad". While he was placed in custody in connection with abuses at SASPAC, while he was at its head.

In an official announcement, the Special Prosecution Office announced that the former minister has committed the criminal offense of abuse of office in relation to the procedures followed for the concession for the sterilization of surgical equipment worth 100 million euros. Thus, according to the investigations conducted up to this stage, the former minister is accused of violating equality in public tenders or auctions.

In addition to the security measure, the former minister has also been banned from leaving the country. According to SPAK, former Minister of Health, Ilir Beqaj, should have canceled the sterilization concession contract, after the winning company submitted a higher bid than the value determined by the contracting authority.

He did not take any measures to put the sterilization center into operation, which would have been more economically advantageous, but went directly to the procedure for granting a concession for the sterilization of medical equipment. He did not prevent the conflict of interest between businessman Ilir Rrapaj and former deputy minister Klodian Rjepaj, and he took actions that favored the winning company.

The criminal case, among other things, argues that Ilir Beqaj, although he was aware of the modern sterilization center established at the QSUT, did not take any measures to put it into operation. He did not conduct any preliminary study to assess whether putting the sterilization center into operation would be more economically advantageous.

Also analyzed are the trips that Ilir Beqaj made with businessman Ilir Rrapaj, who owns 40 percent of the concession contract and is currently in prison for the same issue.
