The HCJ rejects the ILD's request for the dismissal of judge Arben Dosti
The Supreme Judicial Council, KLGj announced on Thursday, April 18, the decision to overturn the request of the High Inspector of Justice, ILD, for the dismissal of the judge of Gjirokastra, Arben Dosti, for serious professional violations. The rejection of the ILD's request was voted by all 10 members of the KLGJ present at Thursday's decision-making.

In the previous hearings, the ILD presented the arguments why it sought Dosti's dismissal. According to the ILD, the disciplinary investigation against this judge was started based on a complaint filed by a citizen in 2019, on the conditional release of a repeat offender in violation of the law.

According to the announcement of the ILD, the administrative investigation analyzed 11 decisions given by Judge Dosti in the period 2017-2020 and identified actions or inactions in violation of the law "on the rights and treatment of convicts", incorrect implementation of the material law and procedural, bringing unfair advantage, which is also the direct consequence of the disciplinary violation.

According to the ILD, the irregular exercise of duty by the magistrate has had consequences for the administration of justice, harming the judge's prestige and loss of trust in him, as well as harming the public's trust in justice.

Asked about the decision-making, the HCJ stated that the findings of the ILD do not constitute grounds for dismissal.

Arben Dosti completed his studies at the Magistrate's School in 2013 and until July 2014 completed his internship at the Tirana Judicial District Court. From October 2015, he exercises his function in the Gjirokastër District Court.

Dosti was confirmed in office in December 2021 by the Independent Qualification Commission, after it was concluded that he had provided sufficient explanations for the burden of proof regarding the negative financial balance found during the preliminary investigation in the amount of 36.4 million ALL.

Also, the Commission overturned the negative report of DSIK, as well as the findings on professionalism were not considered penal. The KPK body that decided to confirm Dosti was headed by Genta Tafa Bungo, with Pamela Qirko as rapporteur and Brunilda Bekteshin as member.

The Public Commissioner, Florian Ballhysa, complained that Dosti's confirmation was not based on the law, concluding that this revaluation subject does not reach a reliable level in any of the revaluation criteria. The appeal is expected to be examined in the Special Appeals College./ BIRN
