SPAK officially takes on defendant Benet Beci

The Special Prosecution Office took the mayor of Shkodra, Benet Beci, as a defendant, communicating the charges against him.

Beci is accused of violating equality in tenders, along with 7 other people, for the tender "Strategic development of the energy sector" (research project with a fund of 800 thousand euros).

In the tender held in December 2019, Adela Ruko, the wife of former ARRSH head Evis Berber, is also accused.

The other defendants are: Jonid Kazani, Edlira Mitrushi, Yllka Nishku, Rudin Gjoni and Premtim Dauti.

Benet Beci was investigated at large, while SPAK says he committed the criminal offense while he was the head of KESH (Albanian Electric Power Corporation). 

The mayor of Shkodra accidentally fell into the SPAK net, while prosecutors were investigating former road director Evis Berberi. During the investigation into Berberi, SPAK prosecutors, among other things, seized his wife's phone.

But although they set out to find further evidence incriminating Berber, on Ms. Ruko's phone, prosecutors also found several communications between the former head of roads and the former director of KESH.

One of them, the most flagrant, is related to a tender worth 832 thousand euros, including VAT, developed by KESH for contracting a study on the strategy of the energy sector. Mr. Berberi's wife was appointed chairwoman of the tender's Bid Evaluation Committee.

The study, which was to be conducted in collaboration with Harvard professors, apparently had money to share with two former officials, who wanted not just a little but over 40 percent of the funds. In one of the SMS messages found by SPAK prosecutors, referring to the tender for the study, Evis Berberi writes to Benet Beci: "500 thousand euros for the Harvard professors, 320 thousand euros for us with two school classes."

But Berber's compromising SMS to Beci is not the only evidence. It later emerged that the procurement was carried out exactly that way.

The tender with the object "Development of the Strategy for the Energy Sector" was announced by KESH on January 13, 2020 with a predetermined limit fund of 69.5 million lek or 695 thousand euros without value added tax. Including VAT, the value of the limit fund was 834 thousand euros.

There was only one bid in the competition, which was that of the company Consulting & Management Albania SHPK owned by businessman Ervis Myftari, which offered to perform the service for a value of 69.35 million lek excluding VAT, or 99.8 percent of the limit fund.

A day after the tender, KESH announced the winner, precisely Ervis Myftari's company, which was apparently the instrument that would distribute the money according to the formula of 500 thousand for professors and 330 thousand for those with two grades of school.
