
European Commission: TikTok ads violate the Digital Services Act!

The European Commission today informed TikTok of its preliminary view that the company is failing to comply with its obligation under the Digital Services Act (DSA) to disclose advertisements. The Commission found that the TikTok platform does not provide the necessary information about the content of the advertisements, the users to whom the advertisements are directed, and who paid for the advertisements.
Furthermore, according to the Commission, “TikTok’s ad repository does not allow the public to comprehensively search for ads based on this information, thus limiting the usefulness of the tool.” The Commission’s report is based on research that includes analysis of internal company documents, testing of TikTok’s tools, and interviews with industry experts.
The Commission informs TikTok of its preliminary report that it has violated the Digital Services Act and the company is now able to exercise its rights of defense by reviewing the documents included in the Commission's investigative file.
