The appeal of the GJKKO upholds the decision to release Lefter Koka.

The appeal of the GJKKO has upheld the decision that released former Minister of the Environment, Lefter Koka, from prison.
The First Instance decision was appealed by SPAK, after in December last year, the Special Court decided to terminate the security measure of "prison arrest" for the former minister, in connection with the investigation into the Fier incinerator.
But in today's decision, the GJKKO Appeal has dismissed SPAK's appeal, allowing the former minister to be investigated at large.
"The Special Court of Appeal for Corruption and Organized Crime, with a monocratic panel composed of Judge Tereza Merkaj, today on 26.02.2026, ruled on criminal case no. 66, act, date 17.02.2026 registration, on the appeal of the Special Prosecutor's Office against Corruption and Organized Crime with the subject: "Appeal against decision no. 798, date 11.12.2025, of the Special Court of First Instance for Corruption and Organized Crime, with the subject: The determination of the loss of the power of detention granted to citizen LK, with decision no. 22, dated 23.06.2022, of the Special Court of First Instance for Corruption and Organized Crime, implemented by the judicial police on 29.03.2022, at 09:15 and left in force by decision no. 23, dated 31.03.2022, of the same Court", as follows:
– Approval of decision no. 798, dated 11.12.2025 of the Special Court of First Instance for Corruption and Organized Crime.
"- This decision may be appealed to the High Court according to the law," the Appeals Office notice states.
Lefter Koka has been in prison since December 2021, accused of abuse of office, corruption, and money laundering in the context of the incinerator corruption affair.
According to SPAK, 4 million euros were paid for the Fier incinerator for works that were not completed, while the damage caused to the state budget is estimated at 60 million lek. The GJKKO has also lifted the security measure for this matter, while the file has been returned for retrial to the Special Appeal, following the decision of the High Court.
In July 2025, Koka was released on bail by the Durrës Court for the Elbasan incinerator, where he had received a sentence of 6 years and 8 months in prison with a shortened trial. Meanwhile, for the Fier incinerator he was sentenced in the first instance to 6.8 years, and for the Tirana incinerator to 2 years in prison. In the Tirana case, the security measure “arrest in prison” was terminated after the pre-trial detention period had fully exhausted the sentence.
