Can you sell a product online without a correct address, correct labels, or a guarantee of safety? With the new government law, no longer.

A new package of measures targets non-food products that pose a risk to consumers and imposes strict rules on every link in the trade, from production and import to distance selling. If a product is deemed “dangerous”, it can be banned, withdrawn, urgently warned or destroyed. No product will pass through without control, neither at the border nor on the internet.

The government has proposed a new draft law with substantial changes to the law on the trade and supervision of non-food products, aiming to strengthen control, safety and transparency in the market. The new law includes new definitions, increased obligations for economic operators and clear mechanisms for consumer protection. Among the main innovations is the inclusion of used products in supervision, as long as they meet the legal criteria for safety and compliance. The state prohibits products with serious risks from entering the market and gives the structures the right to order blocking, recall, warning and, in severe cases, even destruction.

For the first time, online platforms and delivery service providers are included in the law, which are responsible for the safety of the products they distribute. Operators offering products to the Albanian market, through language, currency or advertising, will also be controlled as domestic sellers. According to the draft, every product placed on the market must have the company name, address and correct contact details. If they are missing, customs authorities have the right to immediately stop the release for free circulation. This also applies to false CE markings or the lack of instructions in Albanian. Control structures will be able to act with or without warning and will be assisted by the State Police. A Single Liaison Office is also being created that will coordinate the entire market surveillance system and a Contact Point for operators seeking clarification on the legislation.

The product that poses a risk can no longer be returned to the market without special certification. If it does not comply with the rules, after the controls, it will be destroyed or rendered inoperable at the seller's expense. The draft law tasks the ministry with drafting the National Market Surveillance Strategy, as well as approving the communication and information exchange system between domestic and European Union structures. The law will enter into force 15 days after its publication in the Official Gazette, while some of the provisions will be applied after the approval of special acts by the Council of Ministers. This legislative package marks a turning point towards a safer and more controlled market, in accordance with European rules. Albania seeks to no longer be a country where everything is traded irresponsibly, non-food products will no longer be a silent risk for consumers.

POINTS THAT CHANGE TRADING AND CONTROL RULES

1. Hazardous products can be destroyed. State authorities have the right to order the destruction or rendering inoperable of products that are deemed "dangerous" to life, health or the environment.

2. Online sales are subject to full supervision. If the site is in Albanian, accepts payments in lek or distributes in Albania, it is subject to legal obligations, like any physical store.

3. No product without a name and address enters the market. Every product must indicate the name, address and contact details of the economic operator. Without them, trading is prohibited or blocked at customs.

4. State structures can enter and inspect without notice. Inspectors have the right to enter stores, warehouses, vehicles and take samples, documents or immediately stop the marketing of products.

5. Warning only the first time, then a fine In case of minor violations, operators receive a warning and a deadline for correction. If they do not react, they are fined up to 50,000 lekë.

6. A Single Liaison Office and Point of Contact are established. These structures will coordinate supervision between institutions and provide updated information to consumers and businesses.

7. Fake CE? Product blocked at the border If the product bears a fake, incorrect or suspicious CE marking, customs has the right to prohibit release for free circulation.
