In the investigative show "Piranhas", 25-year-old Ardit Lala denounced an injustice done to his late father, Hidër Lala, who passed away in 2020 as a result of Covid-19.

He states that his father was friends with a gentleman from Kukës, Muhamet Sula, who in 2018 appeared below the Lala family's apartment and presented two contracts: a loan contract and a declaration. Both in the apartment and at the Police, where he filed a report, Mr. Lala claimed that this was a form of extortion against him, by his friend Muhamet Sula and the notary in collaboration, Ardian Elezi. Both were accused of "forgery of documents" and "abuse of office".

After the investigation by the Prosecution Office begins, several investigative procedural actions are taken, including an expert report from 2019. Expert Vjolxhin Kuka made comparisons with previous writing models, as well as free writings of Mr. Hidër Lala. After conducting examinations with all the necessary equipment available to the Institute of Scientific Police, he concluded that the 2014 “Declaration” document, the name and surname “Hidër Lala”, should not have been written by the person in question, while as for the signature, “the possibility that it was signed by him cannot be ruled out”.

According to the Prosecution, this was a non-exhaustive decision, so a second expert report was requested, again from the Institute of Scientific Police, on May 8, 2020. The document bears the signatures of experts Durim Çako and Shefqet Xhemollari. The comparison models were the same: the name, surname and signature of Mr. Lala from the aforementioned documents, as well as his freehand writing. The equipment used was also the same. The two experts concluded that the name, surname and signature were not written and signed by Mr. Lala.

This was enough for the Prosecution to question Mr. Muhamet Sula and notary Ardian Elezi as persons under investigation. Both declared that they had not forged any writing or notarial act and that everything had taken place in the presence of the parties. However, the Prosecution did not think so. Taking into account the two acts committed, Prosecutor Rita Gjati sent the case for trial to the Kukës Court, where Mr. Sula was charged with the criminal offense of “forgery of documents”, while notary Elezi was also charged with the offense of “abuse of office”.

But the prosecution requested a third expert report. In the document dated November 6, 2020, the previous experts, Vjolxhin Kuka and Shefqet Xhemollari, are joined by expert Gani Jahelezi. After examinations with the same equipment and methods, they concluded that the name, surname and signature of Mr. Hidër Lala were not written and signed by him.

The case is now being tried on the merits. Two of the experts, having participated in previous acts during the investigation phase, prompted the defendants to request the court to conduct a graphic re-examination with 3 other experts, again from the Institute of Scientific Police. Elvis Mako, Suela Pashaj and Kristaq Gjika were selected.

With the act dated October 25, 2024, these three experts overturned the work of their colleagues from the Institute of Scientific Police and paved the way for the innocence of Mr. Sula and notary Elezi. They concluded that the name, surname and signature of Mr. Hidër Lala in the document “Declaration” were written and signed by him himself.

Based on this latest act, the Court decided to acquit citizens Muhamet Sula and Ardian Elezi.

After this decision, the son of the deceased, Ardit Lala, reported the three experts Elvis Mako, Suela Pashaj and Kristaq Gjika to the Kukes Prosecutor's Office for "false expertise". But the Prosecutor's Office considered that the case should not be investigated. A month later, on June 16, Ardit Lala filed an appeal with the Kukes Court against the decision to "not initiate investigations".
In parallel with the legal proceedings, the "Piranhas" continued their work to clarify the case by confronting the experts.

The first to speak about journalist Freard Rista was Ms. Suela Pashaj, who stated that everyone is responsible for their own actions and that their work is not done only with specialized equipment. During the debate, her husband became aggressive, trying to take the microphone from the journalist, while she herself threatened the journalist by mentioning the Director General of the State Police.

A few days later, the three experts who had given the unanimous decision were seen sitting together in a cafe. When confronted by the journalist, Mr. Elvis Mako immediately left, while Mr. Kristaq Gjika claimed that he was unaware of the case and requested information only through official channels, a well-known way of avoiding debate and the truth./ Piranjat
