Journalist "Qyno" case/ Constitutional Court overturns SPAK for protecting journalists' sources

The Constitutional Court concluded that a journalist's right to preserve their source is one of the constitutional guarantees.

The court concluded that the controls interfered with freedom of expression.

Ordinary courts have not justified why other means were used to discover the source.

The Constitutional Court ruled to overturn the decisions of the lower courts.

As reported by Top Channel journalist Anila Hoxha, the president of the Unconstitutional Court Holta Zaçaj gave details of the decision-making at the press conference.

She said that it is a partial acceptance of the journalist's requests, emphasizing that the seizure is illegal.

Regarding the investigation, she said that it has not yet been exhausted, because it has not yet been subject to review, because the journalist's lawyer has said that he reserves the right to file a lawsuit in the future.

According to the unanimous decision, the seizure of the journalist's work tools is dropped, because, as the court assesses, this was not the way to reveal the journalist's sources.
