Seized 978 mobile phones, SPAK's practice is appealed to the Constitutional

The figure is official data from the special prosecutor's office, which has not excluded from the investigations citizens who have knowledge or who have communicated with citizens under investigation and which it is estimated that these conversations would yield details of interest for further investigations.

Among former high-ranking officials and even politicians, whose phones were the key to cracking criminal files, there are also suspects who were found to be communicating with officials or mentioning their names, and therefore their phones were blocked.

One of them is the case of Onejda Ymeraj, who is requesting the return of the phone taken from SPAK, as it has all the contact numbers she needs for her work registered there.

The lawsuit, as it turns out in the constitutional court, has passed into plenary session and concerns the seizure of Ymeraj's phone, two years after the investigations opened against former Deputy Prime Minister Arben Ahmetaj. Onejda Ymeraj was questioned as a person with knowledge in February 2024 and on the same day she was asked to examine the phone and then seize it.

SPAK's argument results from the acts that there was a mention of the former official under investigation. However, it results from subsequent decisions that the courts did not take into account the return of the plaintiff's phone, which has as an argument the fact that the phone contains contacts that she needs for everyday life.

This issue is constitutional and is no longer about a phone, but about a practice.
