Land acquired with forged documents, Fier Prosecution seizes 276 hectares

The Fier Prosecutor's Office has seized 276 hectares of land suspected of being acquired with forged documents from a person in the village of Hasturkas, Libofshë. Through a notice, it is announced that immovable property of the type "pasture" and "forest" with an area of ​​276.5 ha has been seized and placed in the ownership of T.Zh., through the use of a forged document.

The prosecution indicates that this property was then divided among several owners through sales and donation contracts. Meanwhile, the person with the initials T.Zh. is accused of the criminal offense of 'Laundering the proceeds of a criminal offense or criminal activity' and 'Forgery of documents'.

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier seized an immovable property of the "pasture" and "forest" type with an area of ​​276.5 ha, for the criminal offense of 'Laundering the proceeds of a criminal offense or criminal activity' and 'Forgery of documents', provided for by articles 287 and 186 of the Criminal Code.

In the framework of the investigation into criminal proceedings no. 1419, dated 24.10.2019, it resulted that citizen T.Zh., by using the forged document "Decision no. 249, dated 22.02.2008", etc., of the former Libofshë Municipality, has obtained 276.5 ha of land of the 'pasture' and "forest" type, in the village of Hasturkas, Libofshë, Fier. This property has been divided among several owners through sales and donation contracts.

The investigations revealed that the property was acquired based on the request of citizen T.Zh, decision no. 5, dated 26.09.1999, of the former Libofshë Municipality, Certificate dated 10/10/1999, issued on behalf of the Property Verification Commission of the former Libofshë Municipality, which are forged, as it turns out that these acts do not reflect the writings and signatures of the members (proven by the expert report).

It also results that decision no. 5, dated 26.09.1999, of the former Libofshë Municipality was taken before the request was made and the date on which it was taken corresponds in the calendar to Sunday, a holiday, leading to the conclusion that the property is the product of the criminal offense of forgery of documents.

In the context of the investigations, the Prosecution requested the seizure of assets derived from the forged documents:  Immovable property of the "pasture" and "forest" type with an area of ​​276.5 ha, located in cadastral zone 1940, Hasturkas village, Libofshë, Fier.

This request has been accepted by the Court and the Fier Prosecution has issued the execution orders, which have been sent for implementation.  The Fier Prosecution remains fully committed to combating with priority the criminal offense of laundering the proceeds of criminal offenses and criminal activity, as well as the sequestration/confiscation of the proceeds of criminal offenses.
