The Serbian authorities have not yet announced when and how the dead body of Faton Hajrizi, the Kosovar citizen killed by the Serbian authorities on July 19, will be brought to Kosovo.

Arianit Koci, a lawyer from Kosovo, confirmed for Radio Free Europe that he has been authorized by the Hajrizi family to engage in the procedures to retrieve the body from Serbia. He said that it is not yet known that it is his body and that he expects to leave for Serbia tomorrow or the day after tomorrow.

Hajrizi, who had escaped from a prison in Kosovo on July 6, became a suspect in the murder of a Serbian policeman and the wounding of another in the early hours of July 18 in Lloznica, a city in the western part of Serbia.

The Serbian police's several-hour search for Faton Hajrizit resulted in his capture and murder.

The Ministry of Foreign Affairs and Diaspora of Kosovo announced on July 22 that they have confirmed the identity of Hajrizi from the fingerprints sent by the Serbian authorities through the Directorate of International Police Cooperation (ILECU) within the EU Mission for the rule of law in Kosovo.

According to the current mandate, EULEX supports the Kosovo Police in the field of international police cooperation, including with the Ministry of Internal Affairs of Serbia.

"In the specific case [regarding Faton Hajrizi], EULEX has accepted a request which was processed in accordance with our mandate", this mission told REL.

They did not specify which request it was due to, they said, the confidentiality of the exchanges.

Musa Damati, lawyer and expert in legal issues, in this case sees the lack of legal cooperation between Kosovo and Serbia as problematic.

"If there was legal cooperation between Kosovo and Serbia, those wanted from Kosovo and vice versa would not be able to cross the borders and take shelter in the respective countries, avoiding justice and endangering the security and legal order in both countries," Damati said. for Radio Free Europe.

Serbia and Kosovo have reached the Agreement for Mutual Legal Assistance in 2013, within the dialogue for the normalization of relations, which is mediated by the European Union.

The agreement was amended in 2015 and, based on it, the parties exchange court requests through representatives of the European Union.

The Kosovar authorities have complained in the past that there was sabotage of this agreement by Serbia.

Regarding the withdrawal of Faton Hajrizi's body, Damati thinks that cooperation mechanisms should be used, such as liaison offices between Pristina and Belgrade, and if necessary, pressure "from the international factor" should be sought.

"As the last practice for the return of the bodies, we have the procedure followed in the well-known case of the attack in Banjska, where the family members, through lawyers and administrative-diplomatic procedures, made the withdrawal of the bodies of the family members from the morgue in Pristina to Serbia", said Damati .
