Sali Berisha's lawyers are again using delaying tactics and today there was no decision from the GJKKO on whether or not to proceed with the trial of the Partizani affair file. In order to delay this decision again, the defense lawyers have requested the disqualification of judge Fjorela Davidhi. Attorney Gjokutaj said that they have requested the disqualification with the argument that Davidhi is biased. 

The next session is on May 5, which coincides with 6 days before the May 11 elections. Today, a decision was expected to be made on whether the "Partizani" case, with defendants Sali Berisha, his son-in-law Jamarbër Malltezi and three others, would go to trial, but the lawyers dragged it out again. 

A day earlier, Judge Fjorela Davidhi rejected the defense attorneys' requests for the invalidity and inadmissibility of SPAK's evidence, but did not rule on the case going to trial.

For 6 months, the defense has used various legal means to delay the decision, in an attempt to avoid Berisha facing the court before the parliamentary elections on May 11. The preliminary hearing began in October 2024, but has been repeatedly postponed until now, mainly through various tactics by the defense. If Judge Davidhi decides on May 5 to move the case to trial, this would be Sali Berisha's first confrontation with justice. The decision would be a strong blow for him, and it would come just a few weeks before the parliamentary elections on May 11.

Sali Berisha is accused of passive corruption, as he is suspected of having used his position as prime minister to favor his son-in-law in the privatization of the former Partizani sports complex. According to SPAK, he has approved decisions and legal acts to facilitate the process and has exerted pressure on state institutions to accelerate the privatization. Jamarbër Malltezi, Berisha's son-in-law, is under house arrest and is accused of passive corruption and money laundering. He is suspected of having benefited from 5.4 million euros from the privatization and construction of palaces on the land of the former Partizani club.

Fatmir Bektashi, a businessman and collaborator in the project, is accused of active corruption and money laundering. Xhimi Begeja, co-owner of the land and partner in the company “Homeplan”, is accused of money laundering. Andia Pustina , former financier of the company “Homeplan”, is also accused of money laundering, as she managed the financial and legal operations of the company. In addition to them, SPAK has also charged the companies Homeplan sh.pk, Studio Pustina sh.pk and Kontakt sh.pk with money laundering.
