Ceno Klosi "drowns" in the channels of the Strategists/ KLSH: Favored "Gjikuria" in the 4 million euro contract

Ceno Klosi, one of the new deputies of the Socialist Party and a close associate of Deputy Prime Minister Belinda Balluku, may have serious problems with the criminal law. The Supreme State Audit Office (SSA) has found numerous and abusive tolerances that he made to the company "Gjikuria", while he was leading the National Agency for Water Supply, Sewage and Urban Waste (AKUM).
The main violations were found in the implementation of the over 4 million euro project for the construction of the wastewater sewerage network for Dhërmi.
The Supreme Audit Office has discovered that "Gjikuria" carried out works without being provided with a construction permit and holds Ceno Klos responsible for this, while his successors at the head of AKUM have not applied penalties of over 1.6 million to the private company, due to the almost 3-year delays in completing the project.
These serious conclusions are listed in the recently published "Compliance Report at the National Water Supply and Sewerage Agency".
Ceno Klosi served as head of AKUM for the period from June to November 2021. He replaced Alqi Bllako in that position, who took the mandate of the Socialist Party deputy and is now sentenced to imprisonment for what is considered the "incendiary affair".
The Supreme State Audit considers both Bllako and Ceno Klosi responsible for allowing the construction of the sewage canal project in Dhërmi without a construction permit.
In July 2020, AKUM, which was led at the time by Alqi Bllako, closed the tender for the object " Wastewater treatment plant and KUZ system Drimadhë, Dhërmi ", with a limit fund of 400,304,509 lekë including VAT (about 4 million euros).
The winner was the company "Gjikuria" and a contract was signed between the parties for the completion of the works in August of that year.
Data provided by the Albanian Supreme Audit Office revealed that the private company, throughout the entire time, has carried out works without being provided with a construction permit.
" The National Water Supply and Sewerage Agency submitted an application to the electronic permit system on 03.03.2020, addressed to the Territorial Development Agency with no. AN030320200094. The ARD responded on 02.06.2020, stating that the request was rejected ," the state auditors' report states.
Afterwards, AKUM tried again to obtain a construction permit, but was again rejected.
The report of the Supreme State Audit Office states:
“Është kryer ri-aplikimi nga AKUK në sistemin elektronik në datë 29.07.2020, drejtuar AZHT me nr. AN290720200182, ku edhe kjo është refuzuar, pasi sipas shkresës me nr. 1614/1, datë 14.08.2020 nga AZHT, kërkohet plotësimi i dokumentacionit, ku janë të parashtruara saktë 8 kërkesat që duhet të plotësojë Autoriteti Kontraktor, në zbatim të neneve 28,39,43 të ligjit nr. 107/2014 “Për planifikimin dhe zhvillimin e territorit”, i ndryshuar”.
Kjo korrespondencë institucionale tregon qartësisht se Agjencia Kombëtare e Ujësjellës-Kanalizimeve nuk ka plotësuar dokumentat e kërkuara.
Pas dy tentativave të dështuara, AKUM-i ka lejuar vijimin e punimeve të projektit pa u pajisur me leje ndërtimi.
“Rezulton se punimet kanë nisur dhe kanë përfunduar nga kontraktori i punimeve OE “Gjikuria” pa disponuar deri në fund lejen përkatëse të ndërtimit, veprime këto në kundërshtim me në ligjin 107/2014 “Për planifikimin dhe zhvillimin e territorit”, neni 39”, thotë KLSH-ja.
Pas këtyre konstatimeve, audituesit shtetërorë i kanë vendosur edhe emra të përveçëm personave përgjegjës.
“Veprimet dhe mosveprimet e mësipërme janë në kundërshtim edhe me parashikimet e ligjit nr.
8402, datë 10.09.1998 “Për kontrollin dhe disiplinimin e punimeve të ndërtimit”. Për sa më sipër, ngarkohen me përgjegjësi: z. Alqi Bllako dhe z. Ceno Klosi,, në cilësinë e ish-itullarit të Agjencisë Kombëtare të Ujësjellës-Kanalizimeve”, thuhet në raportin e KLSH-së
AKUM i fal 1.5 mln euro “Gjikurisë”
Tenderi 4 milionë euro për kanalet e Drimadhes dhe Dhërmiut nuk kanë pasur problem vetëm me lejen e ndërtimit. Megjithëse në mungesë të këtij dokumentacioni thelbësor, “Gjikuria” ka tejkaluar jashtëzakonisht shumë afatin e përfundimit të veprës publike.
Në dokumentat e tenderit parashikohej që Impiant i trajtimit të ujërave të zeza dhe sistemi KUZ Drimadhë, Dhërmi duhet të përfundonte për një afat 1-vjeçar, pra, maksimumi në maj 2022.
Por, Kontrolli i Lartë i Lartë i Shtetit konstatoi se, “deri në dhjetor 2024, objekti nuk është kolauduar dhe kjo kontratë nuk ka përfunduar, edhe pse kanë kaluar 3 vite nga afati fillestar i përcaktuar në kontratë”.
Në këto kushte, Agjencia Kombëtare e Ujësjellës-Kanalizimeve do të duhej të kishte aplikuar penalitetet për mos-përmbushjen në kohë të kontratës.
Sipas përllogaritjeve të ekspertëve të KLSH-së, ky penalitet arrinte në vlerën e 159.321.194 lekë të reja ose 1,6 milionë euro.
Por, AKUM-i nuk e ka aplikuar këtë penalitet, duke “vepruar në kundërshtim me nenin 37 të kontratës nr. 2135, datë 17.08.2020, lidhur me objektin “Impiant i trajtimit të Ujërave të Ndotura dhe sistemi KUZ Drimadhë, Dhërmi”, thotë KLSH-ja në raportin e saj.
The National Water Supply and Sewerage Agency has never expressed an amendment (extension) of the contract term, but " has been satisfied with a written correspondence, where each party has presented its objections regarding the delays in implementing the deadlines ."
In the event of non-fulfillment of the contract beyond the maximum deadline (May 2022), AKUM should have stopped payments to "Gjikuria".
But, as the KLSH notes, " although 796 days have passed since the contract deadline and the works have not yet been completed, AKUM has continued to make payments, namely 20,148,330 lek (dated 29.07.2022) and 15,000,000 lek according to the situation on 17.07.2024 ."/ BOLDNEWS
