"Partizani" file/ Berisha's lawyer falls ill again, GJKKO is expected to postpone the decision again
For six months, the Special Court Against Corruption and Organized Crime (SCAC) has been holding periodic hearings regarding the "Partizani" case, where the main defendant is former Prime Minister Sali Berisha, accused of corruption in collaboration with his son-in-law, Jamarbër Malltezi.
In recent hearings, defense lawyers have requested the invalidation of the file acts and the dismissal of the criminal case, arguing that there are no elements of a criminal offense. According to them, the expert reports are invalid because they were conducted by investigators of the National Bureau of Investigation and not by specialized experts, as provided for by law.
The defense also challenged the evidence regarding the change of destination of the “Partizani” sports complex, emphasizing that this decision was made by Edi Rama and not by Berisha. In this context, the lawyers raised the question of why Rama was not questioned regarding this issue.
The court is not expected to announce the decision on the fate of the process today, but decided to take additional time and make it public on April 23, at 1:00 PM.
There are three options that the court is considering: accepting the Prosecution's request to take the case to trial, returning the file for further investigation, or accepting the defense's request for the final dismissal of the case.
At the end of the session, Berisha's lawyer, Genc Gjokutaj, said: " Today's session was postponed due to the absence of the lawyer who had a health reason. Initially, another lawyer was assigned, but since it is the last session and in the service of an effective defense, it was better to postpone the session ."
