After the "ping-pong" between SPAK and the Tirana Prosecutor's Office over whether or not to investigate a criminal complaint against Prime Minister Edi Rama and his wife Linda Rama, the issue has also brought the Special Court into conflict with the Tirana Court.

The two courts claim that they are not competent to review an appeal filed against the Tirana Court's decision not to initiate an investigation against the accused.

In such a situation, the case, which has become a "hot potato", has been forwarded to the High Court. Through a decision dated April 15, Special Judge Irena Gjoka requests the assistance of the High Court to resolve the competence to review the appeal. The "strumbullari" of the case is a report to SPAK by lawyer Ardiana Kalaja, also a DP official, against the Rama spouses, but also against the Prime Minister's brother, Olsi Rama, the Secretary General of the Council of Ministers, Engjëll Agaçi, the former head of the Cadastre, Artan Lame and other officials who could emerge from the investigation. According to her, the reported had committed several criminal offenses, including forgery, abuse of office and corruption, during the registration procedure and the transfer of ownership to the Prime Minister's wife through the purchase of a plot of land in the Dajti area. After verifications, SPAK assessed that there were no circumstances that were investigated by this structure and transferred the report for competence to the Tirana Prosecutor's Office. After several months of investigation, the latter decided not to initiate criminal proceedings, a decision that was contested by the complainant Kalaja in the Tirana Court, which transferred the case for competence to the Special Court. But in this court, Judge Irena Gjoka assessed that the Special Court had no competence.

In the circumstances where two courts do not accept jurisdiction, Judge Gjoka raised the dispute to the Supreme Court. After the transfer of the acts, the Supreme Court will determine which court will review the appeal, where it will be decided whether or not the investigation against the head of government, his family members and several senior officials will continue.
