"The property settlement that was not done in '91 will now be done

During the meeting with residents of Kamza, the political leader of the Euro-Atlantic Coalition, Lulzim Basha, spoke about the points of the program for Property Reform. Basha emphasized that the principle “Utis Posidetis” will be used, which means that whoever has free property, the property will be returned and the ownership over the property will be recognized, and where it is occupied, it will be compensated at market value.

He said the bill is 8 billion euros, to be paid for by a combination of public funds and public assets. According to him, if this had been resolved earlier, the bill would not have been so high.

Excerpt from Basha's speech:

There are three main damages that have been done to the owners. The first, the expropriation by the communist regime, which now says it will compensate them with 3% of the value of the property, which is a second expropriation. The second, 7501 and the third, the occupation of the once agricultural land then land during the massive process of population movement in the period 90-2025.
How is it resolved?
It is resolved with a very ancient principle, which is today taught in the first semester of the law faculty in the first year, in every law school. And it has remained in Latin because it is a principle of Roman law, which is called "Utis Posidetis", as it is possessed. Whoever has free property, the property is returned to him and the possession over the property is recognized. It does not matter if the state or someone else has taken it, if the property is free and unused, this property is returned immediately and any bureaucratic or judicial process against the owner is stopped.
Where property is occupied, it doesn't matter who occupied it, the state or the private sector, the property is compensated at market value, it is taken over by the state. And here was the problem with legalization. We are waiting for the money from legalizations to be collected, so that we can compensate the owners. No, these are two problems that need to be solved immediately by cutting the Gordian knot.
How much is the value? 8 billion euros is the value we calculated. If we had done this work in 1991, it would have been 1 billion. If we had done it 4, 5 years ago, it would have been 5 billion, today it is 8 billion euros. It will be paid for by a combination of public funds, that is, the state budget, public assets, those assets that it gives to the Strategic Investment Corporation and public companies, KESH, their revenues. It is the Croatian model, they also had their own problem of this type and that is how they solved it. That is how we will solve it too.
The bond, which has a value of 8 billion euros, will be repaid over a 20-year period 1/20 each year, but the title will be issued immediately.
