SPAK accuses the head of the Public Procurement Commission, Jonaid Myzyri, and his subordinates of directly interfering in decision-making, by declaring the winner of the tender for the maintenance of the Rreshën-Ura e Repsit road the union of economic operators that had submitted the highest bid, causing damage of approximately 500 thousand euros to the state budget.
"The Public Procurement Commission has not correctly implemented the law, as with its decisions it has not instructed the contracting authority to correct possible violations or to stop its illegal behavior, but has directly intervened by dictating to the contracting authority the method of evaluating economic operators," the file states.
SPAK adds that during the investigation it resulted that the Public Procurement Commission dictated to the contracting authority, in this case the Albanian Road Authority, that the merger of economic operators Alb Shpresa, Mela and Xhast, as well as the economic operator Jubica, be evaluated less than the merger of economic operators AEK Munella and Drini-1, in order for the latter to be ranked with higher points and result in the winner.
"Exceeding the powers of the Public Procurement Commission has led to unequal treatment of participating economic operators, undermining competition between them and damaging the efficiency of public procurement procedures, as well as causing economic damage to the state budget in the amount of over 47 million lek," the file states.
The damage caused is the difference between the bid submitted by the joint venture of economic operators Alb Shpresa, Mela and Xhast, which was initially assessed by the contracting authority as the highest with points, and the joint venture of economic operators AEK Munella and Drini-1, which, after re-evaluation by the contracting authority and after two consecutive decisions of the PPC, was ranked with the highest points.
According to SPAK, the Public Procurement Commission should have directed the contracting authority to cancel the procedure, with the aim of reopening it, giving economic operators who meet the criteria set by it the opportunity to compete.
Jonaid Myzyri has been indicted along with five of his subordinates on charges of violating equality in tenders and has been suspended from duty by decision of the Special Court./BW
