Italian man who tried to destroy apartment with excavator acquitted of charges

Sandro Mugnai, a 56-year-old craftsman from San Polo (Arezzo), who in 2023 shot and killed his neighbor, Gëzim Dodoli, after the Albanian had attempted to demolish his house with an excavator, was fully acquitted of the charges "because the act did not constitute a crime."

The decision was made yesterday afternoon, December 5, where prosecutor Laura Taddei, in the last hearing session, had requested a reclassification of the charge from intentional murder to "excessive self-defense", requesting a sentence of four years in prison.

Two years after the murder, the Serious Crimes Court of Arezzo ruled that the act did not constitute a crime.

"Now I will try to find peace of mind,"  commented Sandro Mugnai.  "I am happy with this decision, but for me, there is nothing to celebrate. Because a person is dead."

Francesca Cotani, the victim's lawyer, said:  "If we accept the verdict's argument, starting tomorrow, if someone breaks into my car, I can go out the window and shoot them."

"The three shots were fired after the excavator had stopped and changed direction. Mugnai accepted the challenge and fired,"  she added.

The incident occurred in 2023 due to tense neighborly relations between the perpetrator and the victim. On the evening of January 5, Gëzim Dodoli first destroyed the cars parked in front of Sandro Mugnai's house in San Polo, a small village in Arezzo, with an excavator, and then directly hit the walls of the house where the 56-year-old was having dinner with his family. Mugnai then took out his rifle and shot first once in the air, then four more times at the neighbor who was driving the excavator, killing him.
