Important decision made today in the court process against former KLA leaders

This Wednesday, one of the most important decisions in the judicial process against the former leaders of the Kosovo Liberation Army, Hashim Thaçi, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi, is expected to be made.

The trial panel in the “Thaci et al.” case has set July 16 as the date to announce its decision on the motion filed by the defense teams, which seeks to dismiss several counts of the indictment for war crimes and crimes against humanity. This decision is expected to have a direct impact on the further course of the trial, which has now entered its final phase.

The hearing will begin at 09:00, and is expected to continue throughout the day with the hearing of expert witnesses from the Office of the Victim Advocate. The court has ordered that the experts be available regardless of the decision on the motion, as its nature, according to Judge Charles Smith, is limited and the trial will move on to the next phase.

Lawyer Taulant Hodaj has emphasized the importance of this phase, describing it as a “filter” that can determine the further course of the process. “If the indictment is weak based on the evidence presented by the prosecution, the court can dismiss some of its points. But it can also decide not to dismiss any or to proceed with all of them,” he stated. According to Hodaj, a decision to dismiss some points would also affect the final decision, which is expected at the end of this year or early 2026.

Meanwhile, the Special Court has issued the final decision in the case of Salih Mustafa, confirming the Appeals Court's verdict with a sentence of 15 years in prison. In the case of Pjetër Shala, the Appeals Court has reduced the sentence from 18 to 13 years, while the parties can file complaints for the protection of legality in the Supreme Court.

The representative of the Kosovo Law Institute, Blendina Veliqi, explains that at this stage, no evidence is evaluated, but allegations of violations of the law may be submitted, which, if accepted, may lead to a reconsideration or change of the decision.
