The appeal of the Criminal Court returns Vangjush Dako to prison

The appeal of the GJKKO leaves in force the GJKKO decision for the former mayor of Durrës, Vangjush Dako.

This is about the decision taken on November 25th of last year, through which the Special Court sentenced Vagjush Dako to 2 years and 8 months in prison.

Former socialist mayor Vangjush Dako has so far served 6 months of detention and 13 months of house arrest.

While Vangjush Dako must serve the remainder of his sentence in prison.

"The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Engert Pëllumbi (presiding), Miliana Muça (member) and Iliriana Olldashi (member), today on 16.09.2025, announced the decision on criminal case no. 27 act, date 02.04.2025 registration, on the appeal of the defendants/appellants VD, FF, AB, against decision no. 70, date 25.11.2024 of the Special Court of First Instance for Corruption and Organized Crime, and decided:

1. Dismissal of the appeal of the defendant FF against decision no. 70, dated 25.11.2024, of the Special Court of First Instance for Corruption and Organized Crime.

2. Leaving into force decision no. 70, dated 25.11.2024, of the Special Court of First Instance for Corruption and Organized Crime", the official announcement states.

1. Dismissal of the appeal of the defendant FF against decision no. 70, dated 25.11.2024, of the Special Court of First Instance for Corruption and Organized Crime;

2. Enforcing decision no. 70, dated 25.11.2024, of the Special Court of First Instance for Corruption and Organized Crime;

3. The court costs, including those of the appeal trial, shall be borne jointly by the defendants;

4. Promulgated in Tirana, today, 16.09.2025.

We recall that against the former socialist mayor, SPAK requested the conviction of Vangjush Dako for "abuse of office" in two cases and requested 4 years in prison.

But, due to the summary trial, Vangjush Dako was sentenced to 2.8 years in prison.

The former mayor of Durrës, Vangjush Dako, is accused of committing the criminal offense of "abuse of office" on two occasions.

One case concerns the construction of a building in Durrës 11 years ago, which collapsed in the earthquake in November 2019, and the other case concerns a tender for the construction of a promenade in 2014-2015, which caused 18 million lek damage to the state budget.

According to the investigations of the Special Prosecution Office, it has resulted that in 2014 the Municipality of Durrës carried out a procurement procedure, for consultancy services, for the provision of a project called “Design and implementation for the Coastal Promenade and the public beach from Bërryli to Currila”. With Order No. 84 dated 11 September 2013, protocolled with No. 4151 Prot., on the same date, a commission was established to determine the technical specifications.

This group is tasked with preparing: the design task, the limit fund, the terms of reference and all technical specifications for this procurement procedure. The members of the Commission set up by the Mayor of Durrës, the defendant Vangjush Dako, incorrectly calculated the limit fund, with a value almost ten times higher than what should have been calculated based on the Decision of the Council of Ministers, No. 444 dated 05 September 1994 “On the fees for the study, design, management and approval of construction works”.

The Mayor of Durrës Municipality, the defendant Vangjush Dako, issued the procurement order with the value calculated by the Commission, while after the contract was concluded based on its content, payment was made for only 60% of the total value. Even after the Supreme State Audit Office informed the Commission and the Head of the Contracting Authority of the error made by the Commission and the Head of the Contracting Authority in June 2015, leaving a recommendation to recover the economic damage caused up to that stage, the Municipality of Durrës and the relevant administration continued with the payment of the second installment of 40% of the total value of the contract in December 2015, while the entire overpaid amount of 18,318,400.2 lekë was reflected in the financial statements of the Municipality of Durrës as an economic damage and obligation that the beneficiary company has towards this Municipality since 2016 onwards.

The Special Prosecution Office against Corruption and Organized Crime has filed a request with the Court with the subject matter: "Sending to court the criminal case against the defendants: Vangjush Dako, accused of committing the criminal offense of "Abuse of office" committed in collaboration provided for by Articles 248 and 25 of the Criminal Code 2 (two) times, Fiqiri Farruku, Fatmir Ejupi and Adrian Bulku, accused of committing the criminal offense of "Forgery of seals, stamps and forms" committed in the form of forgery of forms approved by the person responsible for their drafting and in collaboration, provided for by Articles 190/3 and 25 of the Criminal Code".
