In the circumstances when the Constitutional Court was divided 4-4, not giving a decision on the government's request whether SPAK's request to suspend Belinda Balluku was interference in the affairs of the executive, Prime Minister Edi Rama warned on Monday that "the socialist parliamentary group will engage in a solution through intervention in legislation."

Prime Minister Rama seems to have entrusted the legal changes, and more specifically Article 242 of the Criminal Procedure Code, to Justice Minister Besford Lamallari.

But first, let's look at what Article 242 of the Criminal Procedure Code provides for "Suspension of the exercise of a public duty or service", which SPAK first used when it requested the suspension of Belinda Balluku from the positions she held.

" With the decision ordering the suspension of the exercise of a public duty or service, the court temporarily prohibits the defendant, in whole or in part, from the activity related to them. This measure does not apply to persons elected under the electoral law."

Top Channel learns that the expected changes to this article foresee the disallowance of suspension from duty of all officials whose functions derive from the constitution.
