Veliaj's reinstatement as mayor / Constitutional Court decision revealed

The Constitutional Court has made public the decision regarding the dismissal of the Mayor of Tirana, Erion Veliaj, ruling in his favor and overturning the decisions taken by the Council of Ministers and the President of the Republic.

In the public plenary session held on October 31, 2025, the Constitutional Court, under the leadership of President Holta Zaçaj and with the presence of all members, examined the request submitted by Erion Veliaj, represented by lawyers Alban Dokushi and Ermal Yzeiraj. In this process, the President of the Republic and the Council of Ministers participated as interested parties.

By majority vote, the Court decided to accept the request and annul decision no. 539, dated September 25, 2025 of the Council of Ministers “On the dismissal from office of the Mayor of Tirana, Mr. Erion Veliaj”, considering it contrary to the Constitution of the Republic of Albania.

The CC's decision:

-Abolition of decision no. 539, dated 25.09.2025 of the Council of Ministers "On the dismissal from office of the Mayor of Tirana, Mr. Erion Veliaj", as incompatible with the Constitution of the Republic of Albania.

-Abolition of the decree of the President of the Republic No. 350, dated 01.10.2025 “On setting the date of partial local elections for mayors, for some local government units” for the part that sets the date of local elections in the Municipality of Tirana, as incompatible with points 2 and 3 of article 115 of the Constitution.

-Continuation of the measure of suspension of the decree of the President of the Republic No. 350, dated 01.10.2025 "On setting the date of partial local elections for mayors, for some local government units" for the part that sets the date of local elections in the Municipality of Tirana, until the entry into force of this decision.
