Hide the sentence in Greece, SPAK takes the mayor of Kučova, Kreshnik Hajdari, as defendant

SPAK accuses the mayor of Kučova, Kreshnik Hajdari, who is accused of concealing a sentence in Greece, when he was an illegal immigrant. Hajdari is accused of the criminal offense of "Forgery of seals, stamps or forms". Hajdar's file is sent to the GJKKO for trial.
NOTICE
The Special Prosecutor's Office against Corruption and Organized Crime, dated 18.12.2023, submitted the request for trial of criminal proceedings no. 80 of 2023, in charge of the defendant Kreshnik Hajdari, currently acting as the Mayor of the Kučovo Municipality, accused of committing of the criminal offense of "Forgery of seals, stamps or forms", more than once, provided by article 190/2 of the Criminal Code.
From the acts administered in the framework of the investigation of criminal proceedings no. 80 of 2023, it was found that the citizen Kreshnik Hajdari, being a candidate for the Mayor of Kučovo Municipality, in the elections for local government bodies held on June 30, 2019, has had the legal obligation and completed the self-declaration form (dated 11.05.2019), which he submitted to the Central Election Commission (protocol no. 3222, dated 13.05.2019).
With decision no. 2, dated 20.05.2019, of the Area Commission for Electoral Administration no. 63, Berat District, it has been decided that the citizen Kreshnik Hajdari will be registered as a candidate for the Mayor of Kuçovo Municipality, in the elections for the local government bodies on June 30, 2019. At the end of the election process, the citizen Kreshnik Hajdari has been elected and won the mandate of the Mayor of the Kuçovo Municipality, a position he exercised in the years 2019-2023.
In the content of the self-declaration form, dated 11.05.2019, the declarant, citizen Kreshnik Hajdari, affirmed that he has never been under investigation or trial by a foreign authority for committing a criminal offense, and he has never been convicted by a final decision by an Albanian or foreign judicial authority.
Likewise, citizen Kreshnik Hajdari, being a candidate for Mayor of Kučovo in the local elections for local government bodies held on May 14, 2023, had the legal obligation and filled out the self-declaration form dated March 26, 2023, which he submitted to the Central Election Commission (recorded with no. 17366, dated 02.04.2023).
With decision no. 5, dated 28.03.2023, of the Area Commission for Electoral Administration no. 64, Berat District, it has been decided that the citizen Kreshnik Hajdari will be registered as a candidate for the Mayor of Kuçovo Municipality, in the elections for local government bodies on May 14, 2023. It turns out that in the elections held on 14.05.2023, the citizen Kreshnik Hajdari is re-elected as Mayor of Kučovo Municipality for the years 2023-2027.
In the content of the self-declaration form dated 26.03.2023, the declarant, citizen Kreshnik Hajdari, affirmed that he has never been under investigation or trial by a foreign authority, for committing a criminal offense, and he has never been convicted with a final decision by an Albanian or foreign judicial authority.
From the acts administered, the evidence received via letter from the Greek Justice Authorities, it results that the citizen Kreshnik Hajdari is convicted by the final decision of the Court of First Instance Ioannina/Criminal Court with One Member, No. 3286/23- 6-1999, with the re-education measure of reprimand, for the violations: Entering the Greek territory without maintaining the relevant legal formalities (violation of Article 4 §§1 and 3 of Law 1975/1991).
The defendant Kreshnik Hajdari had the legal obligation to declare this circumstance in the self-declaration form, in relation to his conviction by a foreign court, this pursuant to law no. 138/2015 "On guaranteeing the integrity of persons who are elected, appointed or exercise public functions", as well as the decision of the Assembly no. 17/2016, "On the determination of detailed rules on the implementation of the prohibitions provided for in law no. 138/ 2015 "To guarantee the integrity of persons who are elected, appointed or exercise public functions".
This fact was not declared in the two self-declaration forms dated 11.05.2019 and 26.03.2023, thus consuming the elements of the criminal offense "Forgery of seals, stamps or forms", more than once, provided for by Article 190/ 2 of the Criminal Code.
