Journalist Klodiana Lala, invited to the show "The Unexposed" on MCN TV, spoke about the wiretapping of a member of the Constitutional Court by SPAK, with suspicions that he may have attempted to influence the decision to use SKY ECC communications. 

"Pëllumb Gjoka is accused of murder, organized criminal group, etc. 

The Constitutional Court (CC) received a request from Pëllumb Gjoka, for the repeal of the security measure, the repeal of a provision that allows SPAK to intercept, the repeal or declaration as invalid of the SKY ECC interceptions. 

After a long time of holding the case, on December 30, 2024, the decision was made and the GJK issued the decision, saying that the request was dismissed. At first glance, we all interpreted that the GJK had declared Gjoka's request invalid but had legitimized Sky ECC.

The GJK was not clarifying the decision. SPAK says that, in exceeding the deadline, it has accumulated reasonable suspicions, which speak of attempts by persons associated with Pëllumb Gjoka and other persons, to intervene in the GJK and have the decision interpreted and this decision make the SKY ECC interceptions vulnerable or vulnerable. 

This is the reasoning used by prosecutor Klodian Braho, who authorized the wiretapping of Gent Ibrahimi for 15 days. During this time, Mr. Ibrahimi was observed by BKH agents in meetings he held with members of the GJK, persons suspected of having interests and persons suspected of having connections with Pëllumb Gjoka. 

If you read the GJK decision, it is a decision without a decision. GJK has not expressed itself on the legality and usability of SKY ECC. SPAK has acted within legal procedures. SPAK has the authority to wiretap the GJK member. SPAK does not need a court decision.

The GJK did not legitimize the SKY ECC wiretaps. It was neither meat nor fish.

There was a debate in 2016 in the CC and two judges at that time came out against some aspects of the vetting law, both of them are outside the system. Before saying that SPAK is acting illegally, the legislators should know that they have allowed it by law.

"In this specific case, a criminal offense is suspected, passive corruption. I cannot say what the result of these wiretaps has been," said Lala.
