Judges and prosecutors sue the Assembly in the Constitutional Court, demanding the repeal and suspension of the new law on salaries

The National Association of Judges, the Union of Judges and the Association of Prosecutors have officially addressed the Constitutional Court with a request for the immediate repeal and suspension of the new Law No. 95/2026, which changes the scheme for calculating the salaries of magistrates.

Overshooting of the deadline by the Assembly: The Constitutional Court had given the Assembly until July 31, 2026 to amend the law. After this deadline passed, the Supreme Court and the Supreme Court of Justice applied the alternative protection formula. However, the Assembly only approved the new law on September 18, 2026, through an accelerated procedure and without public consultation.
Violation of financial independence: According to associations, the new law continues to keep the salary of magistrates linked to that of the President (changing only the coefficient from 0.36 to 0.38), a scheme that the Constitutional Court has previously considered inappropriate due to the lack of regular indexation.

Retroactive effect: The plaintiffs raise concerns that extending the law’s effects back in time (from April 1, 2023) risks salary cuts and massive financial recalculation not only for judges and prosecutors, but also for the BKH, the Judicial Police and the administration of the justice system.
Freezing of salaries: The lawsuit comes after an administrative clash where the Ministry of Finance suspended August salaries for magistrates, which were only executed after binding decisions by the Administrative Courts.
Through this lawsuit, the body of judges and prosecutors is requesting the immediate suspension of the implementation of the new law until a final decision is made, in order to prevent serious consequences for the justice system.
