A few hours after approval, Begaj decrees the new salaries of magistrates

President Bajram Bega has decreed the law on magistrates' salaries, which was approved in the early hours of the morning with the votes of the Socialist Party in Parliament.

The President of the Republic today issued the decree promulgating Law No. 95/2026, "On some additions and amendments to Law No. 96/2016, "On the status of judges and prosecutors in the Republic of Albania", as amended", after having previously given his consent for its immediate entry into force.

The President of the Republic gave his consent for the law to enter into force immediately based on the request of the Assembly, which argued the need and urgency for immediate entry into force with the fact that the repeal of the provisions on magistrates' salaries by the Constitutional Court decision had blocked the payment of salaries to all judges and prosecutors, from August 1, 2026 onwards.

Without the entry into force of the new law, the State Treasury cannot release payments to magistrates.

The purpose of the Assembly was to enable the State Treasury to pay judges and prosecutors as of September 18, 2026, for salaries frozen as of August 1, 2026 and thereafter. The entry into force of the law according to the usual procedures would delay this process by 15 to 35 days. The President of the Republic's consent to the immediate entry into force of the law is a prerogative and constitutional instrument, which is justified by the necessity and urgency of the circumstances of the case.

Constitutional arguments and counter-arguments regarding the salary amount can be debated in other competent instances, but the legal unblocking of the salary itself can only be done by enacting the new law.

The law's immediate entry into force requires the President of the Republic to act immediately.

For the President of the Republic, granting consent in this case serves to protect an acute need, directly related to the principle of judicial independence, which is the guarantee of the standard of living and the stability of income for all magistrates in the country.
