Constitutional Court again without a decision on "Balluk", the case is postponed
The Constitutional Court is embroiled in a real scandal, succumbing to pressure from Edi Rama. This Tuesday, it failed again to reach a decision on the Council of Ministers' appeal regarding the Belinda Balluku case, postponing its review for the second time. The meeting in the consulting room, held this Tuesday, did not produce a final decision, leaving the matter open for another session.
It is reported that the Constitutional Court is requesting more time to rule on the conflict of competences between the Council of Ministers and the Special Prosecutor's Office, regarding the question of whether or not a member of the government can be suspended during a criminal investigation. This decision is considered to have double weight, as it has not only a legal but also a political impact, directly reflecting on the activity of the Assembly and the Council of Mandates.
According to legal deadlines, the Constitutional Court has 30 days to make a final decision, which expires on February 22. However, sources close to the process indicate that due to the high sensitivity of the case and its institutional consequences, the judges are making the most of the time available to create complete conviction on the decision-making.
The postponement of the decision by the Constitutional Court has led, as a direct consequence, to the blocking of the meeting of the Council of Mandates and Regulations in the Assembly, which is considering SPAK's request to lift Belinda Balluku's immunity. Without a final verdict from the Constitutional Court, the socialist majority is not expected to advance in this process.
The lack of transparency over the conduct of meetings and internal debates of constitutional judges remains another problem, as the court does not publish agendas or details on the progress of hearings, leaving public opinion waiting for official information.
Now, attention is focused on the next session of the Constitutional Court, from which a decision is expected that will determine not only the legal fate of the Balluku case, but also developments in the Assembly.
