Today is the deadline, Haxhiu calls the Constitutional Court to account: Who

The acting president of Kosovo, Albulena Haxhiu, has addressed the Constitutional Court to seek clarification on who can exercise presidential powers after the end of her six-month mandate, if the Assembly fails to elect a new president.

This was confirmed by the Office of the President in a written response to Radio Free Europe on October 6 – the day the deadline for electing a new president expires.

According to the Office, Haxhiu submitted the request to the Constitutional Court on October 5, citing Article 113, paragraph 3, subparagraph 1 of the Constitution.

" We have requested to determine how and by whom the necessary presidential powers are exercised after the end of the six-month period, when the new president has not yet been elected," the Office of the President told REL.

Who would call the elections?

The issue takes on particular importance because, if the Assembly fails to elect the president by the end of the term on October 6, it is dissolved according to the Constitution.

The Constitutional Court ruled in March that, if the president is not elected within the specified deadline, the Assembly is automatically dissolved and early parliamentary elections must be held within 45 days.

However, this creates another ambiguity: who would call the elections?

The Constitution recognizes the president's authority to call elections, while Article 90 stipulates that the position of acting president cannot be held for more than six months.

This is precisely one of the issues that Haxhiu has sent to the Constitutional Court for interpretation.

"The Constitution grants this power to the president. Determining the authority that can exercise it in the circumstances is one of the main issues we have presented to the Court ," the Office of the President said.

According to her, the institution's position is that a constitutional solution must be found that enables the announcement and holding of elections within the specified deadlines.
