Helped the former convict, judge Mimoza Margjeka is dismissed

The High Judicial Council has accepted the request of the High Inspector of Justice for "Dismissal from duty" of magistrate Mimoza Margjeka, who is a judge at the Durrës Judicial District Court.
The Office of the High Inspector of Justice presented before the High Judicial Council the arguments for the initiation of disciplinary proceedings on initiative, against the magistrate MM with the duty of judge at the Durrës Judicial District Court, for the disciplinary violation provided for by Article 140, point 2, letter "b ” of the Constitution of the Republic of Albania, as well as from Article 104 of Law no. 96/2016 "On the status of judges and prosecutors in the Republic of Albania", amended, due to the conviction for committing the criminal offense of "Passive corruption of the judge, prosecutor, and other officials of the justice bodies" committed in cooperation, provided by article 319/ç - 25 of the Criminal Code.
Magistrate MM has been declared guilty by the Special Court of First Instance for Corruption and Organized Crime for committing the criminal offense "Passive corruption of the judge, prosecutors and other justice officials", committed in cooperation, confirmed by the Appeal.
The judge was found guilty of actions, which by their nature are of the most serious degree, as are the corrupt acts related to the exercise of the judge's function. The existence of these facts and circumstances in the commission of the criminal offense has been accepted by the court.
From the disciplinary investigation, it is established that active actions were taken by the magistrate by seeking and receiving a monetary amount, actions performed during the exercise of the duty and with the aim of unfairly benefiting from it, favoring a litigant through the decision .
The criminal offense was committed with direct intent with the main motive being the benefit of a monetary amount in return for the performance of an action, specifically the mitigation of the measure of personal insurance against a citizen.
The irregular exercise of duty by the magistrate, as well as the very nature of the criminal offense committed, has brought consequences for the delivery of justice, has seriously discredited the image, authority, dignity and has seriously damaged public trust in the magistrate and the bodies of justice.
As above, the High Inspector of Justice requests the High Judicial Council to initiate disciplinary proceedings against the magistrate MM and assign her the disciplinary measure "Dismissal".
