Fiscal Package 2027: VAT on food reduced to 6%, increased for other goods and

For the first time in Albania, it is intended to apply a reduced VAT to food in the grocery basket.

With the 2027 fiscal package, the government proposes that the VAT on these products be reduced from 20% to 6%, including food basket products, such as: bread and flour, milk and natural yogurt, eggs, rice, pasta, cooking oil, meat, basic fish, fresh fruits and vegetables, legumes, sugar and basic baby foods.

The detailed list of products that will benefit from the reduced rate is expected to be determined by decision of the Council of Ministers.

The proposed changes aim to reduce the prices of food products, a continuing demand of domestic consumer goods producers and importers.

The changes are proposed in the draft law "On some amendments to the law on value added tax".

" Reducing the VAT rate for food products to 6% is seen as a positive instrument to ease the tax burden on basic consumption and improve the affordability of these products by Albanian families ," the draft law states.

But, in addition to the proposed relief for food basket products, the draft law provides for an increase in the general VAT rate from 20% to 21%.

" The review of the standard rate of value added tax, through its determination at 21%, aims to balance the negative effect on budget revenues as a result of the application of the reduced VAT rate for basic food products, thus enabling a stable base of public revenues to meet budgetary obligations and support the financing of public services, investments and economic development priorities ," the report states.

Changes are also foreseen for the tourism sector, where the VAT rate is proposed to be increased from 6% to 10%. Since 2017, a reduced VAT rate of 6% has been applied to the tourism sector.

The approval and implementation of this draft law is expected to bring negative financial effects to the state budget, specifically around 1.6 billion lek.

The effect of increasing the standard VAT rate to 21% is estimated to be positive, at around 10.6 billion lekë. The effect of reducing the VAT rate for basket products to 6% is estimated to be negative, at around 12.8 billion lekë. Meanwhile, the effect of increasing the reduced VAT rate for the tourism sector to 10% is estimated to be positive, at around 614 million lekë.

Likewise, referring to the latest mission of the International Monetary Fund, it has been recommended to review the reduced VAT rate of 6% for accommodation services. According to the analysis conducted by the IMF, it has resulted that the fiscal benefit may have been absorbed mainly by economic operators, in the form of additional income, without necessarily creating a new incentive for tourists.

The development of the tourism sector in Albania over recent years cannot be attributed solely to the reduced VAT rate policy, as the growth of tourism activity began even before the implementation of this measure and was influenced by other factors, such as improved infrastructure and the overall increase in tourism demand.

In light of the above, it is proposed to increase the reduced VAT rate from 6% to 10%. This measure aims to contribute to increasing budget revenues and improving competitiveness.

This proposal does not conflict with European Council Directive 2006/112/EC on the common system of value added tax, as amended, with reference to the definitions in Article 98 and Annex III thereof.

Changing the standard VAT rate to 21%:
The revision of the standard rate of value added tax, through its determination at 21%, aims to balance the negative effect on budget revenues as a result of the application of the reduced VAT rate for basic food products, thus enabling a stable base of public revenues to meet budgetary obligations and support the financing of public services, investments and economic development priorities.

This proposal is also based on the experience of European countries, where the standard rate of value added tax applied varies from 17-27%. While in the countries of the region, this rate varies from 17-21%.

This proposal remains in line with European Council Directive 2006/112/EC on the common system of value added tax, as amended, which establishes the obligation to apply a standard rate of VAT, expressed as a percentage of the taxable amount, not lower than 15%.

Meanwhile, in order to harmonize with this amendment, it is also proposed to remove the phrase "20 percent" from point 3 of Article 146 of the law./monitor.al
