DP appeals to the Constitutional Court the loan agreement with the US

This loan is provided under the US Foreign Military Financing (FMF) program and comes at a time when Albania is trying to raise its profile in the field of defense and security, while aiming to organize the next NATO summit in Tirana.
The majority said that the fund would be extended over 12 years and would be used to strengthen the country's defense capabilities, while the text was kept confidential and passed through a procedure contested by the opposition, which did not participate in the vote.
The complaint by the Democratic MPs alleges that the Assembly committed 7 procedural violations in approving the law in Monday's session through an expedited procedure within 3 hours of the MPs being notified of the legal act.
Announcing the opposition's decision to appeal, the group's leader, Gazment Bardhi, told the media that the opposition supports the agreement in principle, as it is related to the modernization of the Armed Forces and Albania's obligations in NATO, but opposes the procedure followed by the majority for its approval.
According to Bardhi, the Assembly has violated seven constitutional and Rules of Procedure provisions, denying MPs the time to familiarize themselves with the text of the agreement, financial documentation, and the right to debate and amendments.
He argued that the draft law was placed on the agenda and approved within the same day, without respecting the minimum deadlines set by the Constitution and previous decisions of the Constitutional Court.
The opposition opposed this process in the plenary session, seeking the understanding of the Speaker of the Assembly to follow the regular procedure.
"Unfortunately, in the end neither the Constitution, nor reason, nor understanding decided," said Bardhi, adding that the Assembly had once again played the role of the government's notary.
The DP also claims that the government artificially created an urgent procedure, even though the agreement was approved in principle more than a month ago, and deprived the opposition of the opportunity to seek constitutional review of the agreement before ratification.
Another argument is related to the classification of the agreement as secret, since according to Bardhi, the lack of publication in the Official Gazette makes it impossible for it to enter into force, contrary to constitutional requirements for international agreements.
Also, the DP published data on Wednesday, according to which only 27 out of 140 MPs had signed confidentiality statements to familiarize themselves with the agreement, while of the 74 MPs who voted in favor of its ratification, only 19 appeared to have had access to the document.
