
AKEP proposes new tariffs: To be paid by electronic and postal communications operators


The Electronic and Postal Communications Authority (AKEP) has prepared a document that sets out the new tariffs to be paid by market operators for certain services provided for in the new law “On Electronic Communications”, which was adopted last year. The new law contains a number of new provisions regarding the budget and financing of AKEP as well as principles for tariffs paid by entrepreneurs to cover AKEP’s administrative costs for carrying out its regulatory and supervisory functions.
According to Article 26 of the new law, before starting the activity, each entrepreneur shall notify AKEP according to an approved form. In order to exercise the rights deriving from the general authorization, the authorized entrepreneur does not need to obtain a special decision or administrative act from AKEP. The law provides that AKEP shall register operators or service providers in the electronic database within seven days of receiving the notification and shall notify their registration in writing. AKEP shall further approve by regulation the form and content of the notification, the supporting documentation and the confirmation of registration.
According to AKEP's proposals, the Notification/Registration Confirmation Certificate will be issued to each entrepreneur, after notification and registration in the General Authorization Register, according to point 5 of Article 27 of the Law “On Electronic Communications”. For the service, AKEP proposes a fee of 50 thousand lek. The fee will be applied only once for the first registration of the entrepreneur in the new General Authorization Register.
While the issuance of the Certificate of Confirmation of Changes to the data in the general authorization register is proposed to have a fee of 20 thousand lek. The certificate is issued in cases of notification by the entrepreneur of changes that occurred in the initial or previous information provided.
A third service proposed in the draft regulation will be the issuance of a Declaration or Confirmation Certificate to facilitate the exercise of rights for the installation of facilities and interconnection, which will also have a fee of 50 thousand lek.
They aim to cover the additional administrative costs of AKEP in relation to the first-time registration of entrepreneurs in the new General Authorization register and the regulatory work for the preparation and implementation of by-laws. AKEP also assesses that they are transparent and proportionate, in order to minimize the additional administrative costs of AKEP for the review of each first-time notification under the new GA as well as any subsequent changes to the notification by the respective entrepreneur. According to AKEP, they are reasonable and do not constitute a heavy or excessive financial burden for entrepreneurs of electronic communications networks or services./ Monitor
