The Constitutional Court has today made its decision regarding Prime Minister Edi Rama's request for the security measure imposed on Deputy Prime Minister and Minister of Infrastructure Belinda Balluku, leaving Belinda Balluku's suspension in effect.

According to Lala, the 8-member Constitutional Court body voted 4 to 4, rejecting the government's request.

In the decision announced by the president of the court Fiona Papajorgji, it results that the request did not receive a quorum of votes, being divided 4 in favor of the prime minister and 4 in favor of SPAK. A quorum of 5 people should have been reached. For Ms. Balluku, the measure of suspension from public functions has been reinstated”, said Lala.

The judges of the Criminal Court have been "locked up" in the Deliberation Chamber since 11:00, leaving only a few minutes later to eat lunch.

This was the third meeting of the CC on this issue, with the previous two meetings failing after some members requested more time.
The “Balluku” case is the most public interest case currently being considered by the Constitutional Court, given the reinstatement of Deputy Prime Minister Belinda Balluku.

Journalist Klodiana Lala has stated that the Constitutional Court will hold a marathon session today until it issues a decision regarding Prime Minister Edi Rama's request to declare the security measure for the suspension of Belinda Balluku unconstitutional.

According to Klodiana Lala, if the Constitutional Court were to decide to leave the security measure of suspension from office in force, this would affect the request submitted by SPAK to lift Balluk's immunity.

This is because according to the law, it is not possible to impose three security measures on a person. This would force the Special Prosecutor's Office to waive one of the measures imposed on the minister, namely "Suspension from duty" or "Prevention of leaving the country."

"If the CC considers the suspension unconstitutional, and Balluku only has the measure of preventing him from leaving the country, the request for Balluku's arrest is legitimate," reports Lala.
We recall that SPAK has also requested the lifting of Balluku's immunity and her arrest due to suspicions of abuse in large public tenders.
