BIRN: The list of candidates for KLJ and KLP does not find consensus
SP and PD representatives in the Ad Hoc Laws subcommittee did not agree on the list of candidates from the bar, postponing their election far beyond the legal deadlines.

The Ad Hoc Laws Subcommittee on the election of new members to the Supreme Judicial Council and the Supreme Prosecution Council failed to find consensus on Tuesday to include disqualified candidates in the list of qualified candidates from the ranks of the Bar, a list from which two new members will be elected for each council.

The members of the majority voted against the proposal of the opposition to include in the competition the names disqualified by the General Secretary of the Assembly, Genc Gjonçaj, with the claim that his selection had a political background and used two standards in the disqualification criteria.

The disqualified candidates from Gjoncaj are Përparim Kalo, Alban Alimema, Fatos Lazimi, Entela Shehaj (Memishaj), Saimir Vishaj and Albana Tushe.

The head of the democratic parliamentary group, Gazment Bardhi, proposed their inclusion in the qualified list, but the majority voted against, dropping their inclusion in the race.

According to Bardhi, the vote showed that the SP deputies and the positions of the General Secretary of the Assembly always match, which, according to him, "proves that his exceptions were political in violation of the Constitution and the law."

But the Chairperson of the Laws Commission, Klotilda Bushka, asked the opposition colleague not to prejudice the decision-making in this structure and to respect the legal procedure.

The subcommittee then decided that qualified candidates would be voted on Thursday after they were given an opportunity to present their platforms at a hearing.

According to Gjoncaj's report, the disqualified candidates do not meet the legal criteria, mainly because they do not justify the continuous work as lawyers in the last 10 years or for "tax obligations".

In the list of candidates qualified by the General Secretary from which the 2 new members of the General Assembly will be selected, the lawyer Eris Hysi is ranked first, followed by Erind Merkuri, Erind Gërmenji, Albens Tabaku, Klodian Gjermeni, Artan Reçi, Bledar Bajri and Saimir Kola.

The legal provisions provide that 4 candidates for 2 vacant seats in KLGj and 2 in KLP are subject to voting in a plenary session after they are selected from this list by political consensus (4 votes in favor) by the 5 members of the subcommittee of laws that is established for this purpose.

When there is no consensus, the names from the list are chosen by lot and if the Assembly fails in 3 consecutive votes to elect the new members of the KLJ and KLP with 84 votes, those who have been chosen by lot for the third round are automatically called appointed. .
