The court hearing in charge of the defendants in case 5D has been accompanied by tensions.

The clashes and arguments began after a request for summary judgment.

Denion Bogdani, the lawyer for the defendant Redi Molla, has requested that the judicial review of the case not begin unless a decision is first made on this request.

The lawyers of the other defendants, Ermir Beta and Ardian Leka, also requested a postponement of the hearing for the same reason.

Meanwhile, defendant Taulant Tushe's lawyer Evi Sheri, unlike the others, has requested that the hearing not be postponed, thus causing a debate between them.

The prosecutor in the case, Klodian Braho, stated that the request should not serve as a reason to postpone the hearing.

On July 2, 2024, SPAK communicated the charges of "passive corruption" and "failure to declare assets" to Redian Molla and Mariglen Qato, while Taulant Tushe communicated the charge of "violation of equality in tenders".

The three former directors were arrested in March last year by order of the Special Anti-Corruption Prosecutor's Office, as part of the investigations into the "5D" file.

They were remanded in custody, while five other people were remanded in custody, specifically Enton Punavija, Julian Zanaj, Albano Janku, Nestor Muhamellari, Deborah Keçi and Englatina Zere. According to SPAK, Qato and Molla are de facto owners of the company "5D", which, according to investigations, has been the winner in several tenders at the municipality.

It concerns 11 tender procedures over a period of 6 years, from 2016 to 2022. The company is also known by two different names: "Igor Electric" and "Vas construcion".
