KAS overturns Celibashi's decision and leaves the "Mountain

The Complaints Commission has cleared the way for Parliament to approve the “Mountain Package” and changes to the VAT scheme for agriculture, as they do not violate pre-election rules. Earlier, the head of the CEC, Ilirjan Celibashi, had blocked the government initiative, claiming that it violated the electoral law.

Celibashi, in his decision-making, noted that the initiatives "affect important fiscal policies, may create the perception of using legal means for electoral purposes" and in this context asked the Assembly not to consider them.

"The proposal, approval or issuance of legal or sub-legal acts is prohibited not when it is related to certain fields or sectors, nor when it affects sectoral policies, but when it brings benefits to certain categories of the population. Without benefit, there is no prohibition," the reasoning behind the KAS decision states.

Following the KAS decision, the Minister of Tourism and Economy, Blendi Gonxhja, reacted. Through a post on social networks, Gonxhja writes that "this decision clearly confirms that the proposal of MEKI and the Ministry of State for Local Government is in full compliance with the provisions of the Electoral Code and does not conflict with the applicable legislation in force."
