Cash at the border, customs can block even amounts under 10 thousand euros when there are doubts

The draft law "On the Prevention of Money Laundering", submitted for public consultation, establishes even stronger rules for cash.
When customs authorities discover a holder with an amount of cash below the 10 thousand euro threshold and there is evidence that the cash is linked to criminal activity, they will record this information and the required data as in the case above this threshold.
In this case, when there are such suspicions, the customs authorities may temporarily block the cash by means of an administrative decision in accordance with the legislation. The period of temporary blocking shall not exceed 30 days.
After the customs authorities make a full assessment of the necessity and proportionality of a further temporary detention, they may decide to extend the detention period for up to 90 days.
Where no decision is made within the deadline for further freezing of cash or if it is determined that the circumstances of the case do not justify further freezing, the cash shall be immediately returned to the person from whom it was frozen.
Meanwhile, in cases where customs authorities ascertain non-declaration of amounts over 10 thousand euros at the border, they impose a fine, which is calculated as a percentage of the value. Specifically, 30% of the amount over 10 thousand euros when the total amount of cash is no more than 20 thousand euros.
However, this fine cannot be less than 500 euros; 40% of the amount over 10 thousand euros when the total amount of cash is more than 20 thousand euros but not more than 50 thousand euros and 50% of the amount over 10 thousand euros when the total amount of cash is more than 50 thousand euros.
When customs authorities suspect that the failure to declare constitutes a criminal offense for money laundering and terrorist financing, the criminal report, together with the relevant file, is transferred to the competent judicial authorities for further criminal proceedings, within 72 hours from the moment of verification of the violation./ ekofin.al
