Thaçi's lawyer reacts to Special: Every complaint of the accused was rejected by the Appeals Court

Luka Misetic, the lawyer for former Kosovo President Hashim Thaçi, reacted to the Special Court shortly after it presented "fair trial standards during judicial processes" at this court in The Hague.

The lawyer wrote in a post on social media that the Special Court of Appeal has rejected every request from the former leaders of the Kosovo Liberation Army, who are being held in detention there on charges of war crimes and crimes against humanity.

“The context must be taken into account when assessing the effectiveness of the right to appeal regarding violations of fair trial standards. The defendants in the Thaçi war crimes case...etc. have initiated 37 interlocutory appeals and each of them has been rejected by the Appeals Panel,” Misetic wrote.

The statement by the Special Court spokesman, Michael Doyle, states that this court guarantees "the rights to a fair trial for the accused, in accordance with internationally recognized standards."

“Judges consistently apply the international conventions mentioned in the Constitution of Kosovo, including the European Convention on Human Rights and its case law. If a defendant believes that the rules are not being applied properly, he or she can appeal the decisions to a special panel of independent judges.

Defendants may also file a request for protection of legality before the Supreme Court and may appeal to the Constitutional Court Chamber if they believe that their individual human rights have been violated.

"This system reflects the protection of human rights that also exists before other courts in Kosovo. Defendants have utilized these legal remedies and, in a number of cases, have done so successfully," the Speciale spokesperson said.
