BIRN: After corruption scandal, SP proposes 'privatization' of AKSHI

With the signature of a socialist MP, the Albanian Parliament is expected to consider a legal initiative that aims to transfer the tenders of the National Agency for the Information Society, AKSHI, to a joint-stock company with public and private participation.

According to the draft law submitted to the Assembly by SP MP Erjon Malaj, the National Information Society Agency will no longer conduct procurements and enter into contracts for the maintenance of the country's digital platforms and systems - transferring these tasks to an ICT company, where the state owns at least 51 percent of the shares.

Erjon Malaj is a new member of the Albanian Parliament and the bill he submitted to the Assembly comes after the sensational investigation by the Special Prosecution Office, which revealed the existence of a structured criminal group at the head of the National Information and Communications Agency (NAI), accused of controlling tenders worth tens of millions of euros for the state's digital infrastructure. Among the accused are the controversial businessman, Ergys Agasi, and the long-time director of the NAI, Mirlinda Karçanaj.

However, the practice of controversial legal changes through proposals by socialist MPs is not new and has been applied several times during the past legislature. At the same time, the socialist majority is recently moving towards management with public and private joint-stock companies in several sensitive sectors, including defense.

The draft law submitted to the Assembly seeks the repeal of several points in Articles 4 and 29 of the Law "On Electronic Governance", which provide for the competences of the National Agency for Public Procurement in carrying out centralized procurement and concluding contracts for the construction and maintenance of information technology systems.

Likewise, the NAIS is relieved of its obligation for procurements classified as "state secret" for state administration institutions and those in the field of defense and security and other procurements according to the institutions' requests.

To carry out this task, it is proposed to establish a joint stock company, where the state owns at least 51 percent of the shares, created or authorized by the National Agency for the Development, Operation and Maintenance of e-Government Systems, Platforms and Infrastructures.

In defining its functions, the NAKSHI is only recognized for exercising functions of the following nature: technical standardization, system architecture, and technical support and monitoring of e-government systems.

Meanwhile, Information Technology systems, platforms or infrastructure will be transferred, according to the initiative, "to the administration of ICT operating companies for development, operation or maintenance purposes."

Beneficiary public institutions will pay ICT operating companies based on service contracts for maintenance services of their systems.

Very high net profit ratios in relation to revenue are in fact a distinctive feature of economic entities that have won public procurements from the National Information Society Agency, AKSHI, an office under the Prime Minister's authority, which deals with the state's digital infrastructure.

The director of this institution, Mirlinda Karçanaj, was charged with the criminal offense of violating equality in tenders, committed in the form of cooperation within a criminal group, alongside Ergys Agas, Ermal Beqiri and several other individuals./ BIRN
