'For Mr. Shkëlzen Berisha': SPAK presents evidence in the "Gërdeci" case against Fatmir Mediu

The Special Prosecution Office against Corruption and Organized Crime presented evidence on Tuesday, December 23, in the context of the trial of the criminal case against former Defense Minister Fatmir Mediu, related to the causes that led to the explosion in Gërdec in 2008. The prosecutor in the case, Arben Kraja, found that in May 2008, several fax communications were seized at the Ministry of Defense's liaison center, carried out by this ministry with other institutions.
According to him, this record contains a fax sent from the Ministry of Justice to the Ministry of Defense, without a number or date, with the subject "opinion on a draft decision". The document was recorded at the Ministry of Defense in March 2007.
Kraja explained that in the correspondence between the Ministry of Defense and the Ministry of Justice, the latter responded that, regarding the request for an opinion on the draft decision on the procedure for handling weapons, equipment and equipment of the Armed Forces removed from armament and use, it agrees in principle.
Prosecutor Kraja stated that from the naked eye examination of the contents of the fax document seized at the Ministry of Defense, it is found that, in the upper left corner, it is noted “for Mr. Shkëlzen Berisha”. According to Kraja, this note was not placed in ink, but from the naked eye examination it appears to have been part of the contents of the document that was sent by fax from the Ministry of Justice. SPAK requests that Anjola Agolli, the secretary of the former Minister of Justice, Aldo Bumçi, be questioned as a witness.
Kraja then listed a series of other documents, such as requests for legal aid, court decisions, minutes of telephone directory reviews, etc. According to the prosecutor, referring to the military expertise act, through a November 2007 decision of the Special Commission for the Categorization of Equipment, large-caliber ammunition was categorized for sale, in violation of a government decision of March 2007.
Kraja said that it appears that Mediu was aware of this decision of the Special Commission, and was interested in the progress of the decision-making process.
Medi's legal representatives, lawyers Henrik Ligori and Ardian Visha, requested time to prepare their position on the prosecution's evidence, and the judge in the case, Irena Gjoka, adjourned the hearing to January 14 of next year, at 09:00.
The reopening of the case against Mediu was set in motion after 12 years, at the initiative of the family of one of the victims of the March 2008 explosion at the premises of the former “Tank Brigade”, where 26 people lost their lives and hundreds of others were injured. According to the applicants and SPAK, after the legal changes of 2012 and 2017, the MP no longer has parliamentary immunity for criminal prosecution or his trial and, consequently, there is no obstacle to the investigation and trial of Mediu, who is accused of “abuse of office”.
The case against Mediu went to trial on April 6, 2023 and is currently in the stage of presenting evidence by SPAK.
