The President of the Constitutional Court, Holta Zaçaj, has publicly commented on the debate about the end of her mandate.
Invited to News24, she declared that her mandate ends on the last day of 2025, referring to Article 148 of the civil procedure code. Regarding the vacancies, Zaçaj said that the Supreme Court did not inform him, saying that he read about it in the media.
" I will explain why I think that my mandate ends at the end of 2025, because the provision does not connect this thing with any other type of element. According to the internal regulation, how long do we have a vacuum or do we not have a specific regulation in our organic law, the regulation allows us to go to the code of civil procedure and if we go to article 148 of the code of civil procedure, it is the calculation of deadlines and it is said when deadlines are not calculated by date or month, you will go on the last date, of the week or of the year. This is how I interpret this provision. Because I don't even get it from practice. "Always in 32 years we have had dates of the mandates ", said Zaçaj in other respects.
Zaçaj said that he has turned to Venice, as an advisory body, since, according to it, the Supreme Court, without waiting for the announcement of the vacancy by the Constitutional Court, started the procedures for its replacement.
